인공지능 기술의 발전은 현실이다. 이것을 통해 인류는 보다 풍요롭고 편리한 삶을 구가할 수도 있지만, 영화 터미네이터가 그린 미래의 단면처럼 존멸의 위협에 직면하게 될 수도 있다. 이에 2016년 이래로 세계 각국에서는 인공지능 윤리에 대한 담론이 활발하게 전개되고 있다. 윤리담론을 통해 규범체제의 기초작업을 수행하여 놓으려는 의도가 담긴 것으로 보인다. 이러한 윤리담론은 추후 컨센서스를 형성하며 국제적인 규범을 형성하고 개별 국가가 수용함으로써 법제도를 이루게 될 것으로 예상된다.
이에 본 연구는 기술발전에 따른 부작용에 대처하고자 제시되는 규범적인 대응방안을 검토해 보고자 한다. 우선 ①현재 전개되고 있는 변화의 중심에 서 있는 인공지능 기술에 대한 소개와 ②지금까지 인공지능을 대상으로 발표되어 온 세계 각국의 윤리원칙들을 체계화하였다. 이를 바탕으로 오늘날 규범적으로 논의가 가장 많이 진전되어 국제규범을 형성할 정도에 이른 ③자율형 살상무기시스템에 대한 기존 법적 태도와 향후 발전될 구체적 윤리원칙을 제시하였다.
이를 통해 여러 분야에서의 인공지능 기술의 발전에 따른 규범적인 대응방안을 살펴 보고 현실적인 응용가능성을 타진해 봄으로써 추후 전개될 담론에서 주도적인 역할을 할 수 있을 것으로 기대한다.

The advancement of Artificial Intelligence technology is reality. Through this, mankind could have a richer and more convenient life, but may face the threat of extinction, like the scene by the movie Terminator. Accordingly, since 2016, discourses on Artificial Intelligence Ethics have been actively developed in countries around the world. It seems that there is an intention to carry out the basic work of the normative system through ethical discourse. These ethical discourses are expected to form a consensus in the future, form international norms, and form legal systems of each countries.
Therefore, this study intends to review the normative solutions to cope with the side effects of technology development. First of all, we will briefly introduce the Artificial Intelligence technology to the level necessary for the thesis. Second, ② systematically organize the AI ethics related literatures around the world that have been published so far. Based on this, ③ Introduce the main issues of international humanitarian law regarding the autonomous weapons.
For gaining concrete implications on this issues, ④ this research will conduct a case study to see how the above discussions can be applied into the real case concerning autonomous warships. Through this, by examining the normative solutions along the development of Artificial Intelligence technology, we seek ways to play a leading role in future discourses.

본 연구는 '미술 시장에서 NFT 기술의 도입이 일시적 유행을 넘어 미술 창작가의 권리를 실현하는 계기가 되고 문화 민주주의의 원동력이 될 것인가?'라는 물음을 시작으로, NFT 기술의 의의와 전개 방향에 대한 연구를 시도하고자 하였다. 해외 문헌과 NFT 플랫폼상에서의 직접적 자료 조사를 토대로 NFT란 무엇인지, 그 법적 지위는 어떠한지 그리고 미술 산업에서의 함의는 무엇인지 분석하고자 하였다.
연구 결과, NFT 기술은 그 익명성 개방성 비가역성으로 인해 미술 산업에서 예술품 거래의 투명성을 도모하고 디지털 원작의 실현을 가능케 한다는 긍정적 측면과 함께, 원소유자 및 원작자 식별의 어려움 공표권의 침해 폐기청구권 및 복제전송금지청구권 보장의 어려움과 같은 한계가 있음이 확인되었다. 특히 NFT 구매자는 NFT 원본 파일 자체를 소유하는 것이 아니라 해당 파일로의 독점적 접근권을 구매하는 형태를 띠고 있는데, 이러한 새로운 형식의 거래 방식으로 인해 현행 사법체계와의 충돌이 발생할 가능성이 있다.
그럼에도 불구하고 갤러리 중심의 미술 판매 구조에서 벗어나 새로운 유통 경로를 확보하고, 지분 보유를 통해 소액 구매자의 미술 시장 참여 도모와 추급권의 도입, 창작물의 단계별 보호를 실현할 수 있다는 점에서 NFT의 기술은 큰 의미를 갖는다. NFT 기술의 올바른 정착과 발전을 위해서는 플랫폼 업체와 정부 차원의 많은 노력이 필요할 것이다.

This research starts with questioning whether the current NFT boom would develop into a fundamental change in the Korean copyright industry. Until now, legal implications of NFT in the art industry have not been throughly discussed. The purpose of this research is to attempt to make predictions on the significance of this trend and the direction that this is unfolding into.
According to the results of this research, the ownership structure of NFT is very unique in that it grants an exclusive right to access the original NFT artwork. Due to this unique characteristic and the features of blockchain platforms, many problems can arise when applying this technology to the current legal system.
Despite these challenges, implications of this new technology are significant. With the help of the platform, artists who are not famous will have a wider access to the general public. Furthermore, right of resale can be realized, and copyright protection at each stage of development can be carried out. Therefore, the shortcomings of the NFT technology must be overcome in order for the Korean art industry to move on to the next level.

유전자 편집기술은 현재 의료과학계의 큰 이슈다. 최근 유전자 가위의 일종인 크리스퍼-카스9(CRISPR-Cas9)을 이용한 새로운 유전체교정 기법 개발에 기여한 제니퍼 다우드나(Jennifer A. Doudna) UC버클리 교수와 막스 플랑크 연구소 단장인 에밀리아 샤르팡티에(Emmanuelle Charpentier)가 2020년 노벨 화학상을 받기도 하였다.
이 혁신적인 기술은 그간의 불치병을 해결할 수 있는 좋은 도구가 되는 한편, 인간의 유전자를 직접 편집한다는 점에서 생명윤리 문제가 있을 수 있으므로, 그 연구와 치료를 적절히 통제하는 것은 매우 중요한 일이 된다. 강력한 통제장치가 요구되면서도, 한편으로 융통성이 부족한 포괄적 통제방식은 연구 발전에 독이 되므로 지양하여야 할 것이다. 본 글에서는 우리나라의 현행 생명윤리 및 안전에 관한 법률 의 기존 규정의 문제점을 파악한 뒤, 미국과 일본, 영국 및 유럽연합의 규제방식과 사례를 조명하여 그 해결점을 찾아 몇 가지 제언을 하였다.
1) 포괄적인 금지규정인 생명윤리법 제47조 제1항을 삭제함으로써 인체, 즉 체세포의 경우에는 유전자편집기술에 의한 치료에 대한 연구를 실체법적으로 별도로 금지하지 않도록 하여 유전자편집기술을 엄격히 통제하는 현 상황을 타개해야 할 필요가 있다. 2) 생명윤리법 제10조 이하에서 규정하고 있는 기관위원회의 요건을 현재보다 세부적으로 정하고, 국제협약 등을 참고하여 작성한 기관 내부 혹은 공용기관에서의 가이드라인을 지키지 못할 경우 연구 지원을 중단하는 등 실질적으로 강력한 조치를 함으로써 실효성을 높일 필요가 있다. 3) 유전자치료연구 대상자에 대한 보호에 별도로 규정을 둘 필요가 있다. 4) 기관위원회를 위한 공공 자문기구를 두어 기관위원회가 보다 전문적인 활동을 할 수 있도록 지원하는 제도를 도입하는 것도 고려해볼 가치가 있다. 5) 미국의 가이드라인을 참고하여 안전성 심사를 단계별로 진행하여 현재보다 철저히 시행해야 한다.

Gene editing technology is currently a big issue in the medical science community. Jennifer A. Doudna, professor at UC Berkeley and Emmanuelle Charpentier, head of the Max Planck Institute, who recently contributed to the development of a new genome editing technique using CRISPR-Cas9, a kind of genetic scissors, Won the 2020 Nobel Prize in Chemistry.
While this innovative technology can be a good tool to solve incurable diseases, there may be bioethics problems in that it directly edits human genes, so it is very important to properly control the research and treatment. Although a strong control device is required, on the other hand, a comprehensive control method that is insufficiently flexible should be avoided as it is poisonous to the development of research. In this article, after grasping the problems of the existing regulations of the current “Bioethics and Safety Act” in Korea, the US, Japan, the UK, and the European Union's regulatory methods and cases were examined, and some suggestions were made to find solutions.
1) By deleting Article 47, Paragraph 1 of the Bioethics Act, which is a comprehensive prohibition regulation, in the case of the human body, that is, somatic cells, the gene editing technology is strictly controlled so that research on treatment by gene editing technology is not separately prohibited by law. There is a need to overcome the current situation. 2) The requirements of the institutional committee stipulated under Article 10 of the Bioethics Act are set in more detail than at present, and if the guidelines within the institution or public institutions prepared by referring to international agreements are not observed, research support is suspended. It is necessary to increase the effectiveness by taking strong measures. 3) It is necessary to establish a separate regulation on the protection of subjects for gene therapy research. 4) It is also worth considering the establishment of a public advisory body for institutional committees to introduce a system that supports institutional committees to carry out more professional activities. 5) The safety review should be carried out step by step, referring to the guidelines of the United States, and implemented more thoroughly than the current one.
