표준과 관련된 법으로는 국가표준기본법, 산업표준화법, 계량에 관한 법률이 대표적이다. 본 논문은 4차 산업 대비를 위한 관련 법률의 정비가 필요한 부분뿐만 아니라 법률 상호간 또는 관련 법률 자체에 대한 문제에 대하여 고찰한 것이다. 국가표준기본법의 경우 ‘측정’ 관련 부분은 다시 계량에 관한 법률로 이관이 되어야 할 것이다. 또한 기본이념에 대한 규정을 신설하여 다른 법률과의 관계 정립이 필요하다. 현재 표준 관련 법률의 정의규정에는 관련 용어가 중복되어 있기 때문에 일정한 기준에 의한 정비가 필요하다. 특히 ‘계량’의 정의가 계량에 관한 법률과 국가표준기본법에서 중복되어 있어 국가표준기본법에는 이를 삭제할 필요가 있다. 그리고 국가표준기본법에는 많은 용어가 산발적으로 규정되어 있어 각 용어들은 하나의 카테고리 안에서 정의하는 방식으로 정비가 필요하다. 산업표준화법은 전자적프로그램, 건축물, 서비스 등에 대한 정의규정 도입 검토가 필요하다. 4차 산업에 있어 표준과 표준화의 신속제정과 국제화는 매우 중요하다. 우리나라도 4차 산업과 밀접하거나 세계시장 선점이 필요한 전략기술 분야의 경우 민간기관을 중심으로 신속히 제정할 수 있도록 일본의 사례와 같이 산업표준화법의 개정이 필요해 보인다. 또한 국가표준기본법의 경우 국제표준화 대응역량 강화 조항이 전폭적으로 확대될 것이 요청된다. 그리고 국가표준기본법에 표준화 정책 추진을 위하여 국가표준업무를 실무적으로 주관하는 기관을 명문으로 규정할 필요가 있다.

Standards and standardization are very important as the key to accelerating the 4th Industrial Revolution. The the Framework Act on National Standards(FANS), the Industrial Standardization Act(ISA), and the Measures Act(MA) are typical of the laws related to standards. This paper considers the problem of law interactions or related laws themselves, as well as the parts that require the readjustment of relevant laws for 4th industry preparation. For the FANS, the ‘measurement’ related part will have to be transferred back to the MA. It is also necessary to establish relationships with other laws by establishing new regulations on basic ideology. Currently, the definition of standards-related legislation requires maintenance on a certain basis because of the overlapping terms involved. In particular, the definition of “measurement” is duplicated in the FANS and the MA. So it is necessary to delete it in the FANS. In addition, many terms are sporadically defined in the FANS, so each term needs to be refined in a way that is defined within a single category. The ISA requires a review of the introduction of definition rules for electronic programs, buildings, and services. In the 4th industry, rapid establishment and internationalization of standards and standards are very important. Even in Korea, in the case of strategic technology fields that are close to the fourth industry or require preoccupation in the global market, private organizations can quickly enact them. Therefore, it is necessary to amend the ISA as in the case of Japan. In addition, in the case of the FANS, the provisions related to strengthening the capacity to respond to international standardization are required. In addition, the FANS requires institutions that conduct national standards affairs in practice to implement standardization policies.
