이 글은 제헌과정에서 권력구조에 대한 구상이 어떻게 대립되고 전개되었는지를 고찰 대상으로 한다. 이것은 우리 헌법이 장식적 헌법으로 떨어지게 되고, 우리 정치체제가 건국헌법상의 명문에도 불구하고 결국 권위적 대통령제로 귀착하게 된 원인을 제헌과정 내부로부터 찾는다는 의미를 갖는다. 건국헌법은 공식적으로는 만장일치로 통과되었다. 그러나 권력구조에 관한 규정을 해석하는 틀은 정파에 따라 달랐다. 즉 표면상의 합의에도 불구하고 그 의미에 대해서는 각 정파가 각각 강한 대통령제, 내각책임제, 내각중심제로 다르게 이해했다는 것이 이 글의 요지이다.

This article aims at revealing how ideas of power structure are conflicted and developed in the Constituent National Assembly. I think it can explains from the internal viewpoint of constitution why the First Korean Constitution1948 slides into an ornamental constitution, and why Korean political system falls into an authoritarian system in the period of the First Republic of Korea. The point of this article can be summarized as follows:The First Korean Constitution is unanimously passed in the Constituent National Assembly. But political factions have different frames such as strong presidential government system, parliamentary government system, and cabinet government system from the viewpoints of which they interpret the Constitution respectively.
