이 글은 일본의 아직도 풀리지 않은 전시만행 - 특히 일본군 성(性)노예체제-를 검토하고 이 문제에 대한 진정한 인정과 배상이 아시아의 평화와 화해에 필수적이라는 것을 주장한다. 필자는 국제인권변호사로서 독일, 오스트리아의 유대인 박해에 대한 미국 내 집단소송인 일명 ‘홀로코스트’ 소송에 참여한 경험을 바탕으로 유럽에서의 전후 상황과 아시아에서의 지속적 답보상태를 대비한다. 이 글은 1999년부터 필자의 다국적 소송 및 변호활동 - 미국 연방법원에서의 “황금주 대 일본” 소송 및 일본, 중국, 미국 내 관련 후속 활동들 - 의 전개 및 발전을 회고한다. 이 글은 부시 행정부에서 미국 정부의 외교정책과 행정권 독트린 등 방해가 전시 일본군 성노예 피해자들에 대한 법적 시정조치를 가로막았고 이는 미국의 유럽 내 홀로코스트 소송 지원 사례와는 극명한 대조를 이루고 있음을 밝힌다. 이러한 법적·지정학적 역사를 거슬러 올라가면서, 이 글은 일본군 성노예가 해결되지 않은 만행일 뿐만 아니라, 일본군 성노예 문제를 아시아지역의 단합과 영구평화와 한반도통일로 이끄는 통로가 될 수 있다고 제시한다.
This article examines Japan’s unresolved wartime atrocities―particularly the system of military sexual slavery―and argues that genuine acknowledgment and redress remain essential to regional reconciliation and peace in Asia. Drawing on the author’s direct experience as an international human rights attorney involved in Holocaust-era settlements with Germany and Austria, the article contrasts Europe’s postwar reckoning with Asia’s continued impasse. It recounts the author’s role in developing multinational legal and advocacy efforts beginning in 1999, including the landmark Hwang Geum Joo v. Japan litigation in U.S. federal court, and details subsequent related cases in Japan, China, and the United States. The article documents how U.S. government opposition under the Bush administration― invoking foreign policy and executive authority doctrines―effectively foreclosed judicial redress for victims of Japan’s wartime sex slavery, in stark contrast to U.S. support for European Holocaust claims. By tracing this legal and geopolitical history, the paper situates Japan’s wartime sex slavery not only as an unresolved atrocity but also as a potential catalyst for regional unity and a pathway toward lasting peace and Korean unification.
