성폭력(agressions sexuelles)을 폭행, 위력, 협박, 위계에 의하여 범해진 모든 성적 침해행위라고 규정하고 있던 프랑스는 2025년 1월 21일 국민의회에 비동의간음죄를 도입하는 “강간과 성폭력의 형사법적 정의를 변경하는 것을 목표로 하는 법률개정안(Proposition de loi visant à modifier la définition pénale du viol et des agressions sexuelles)”이 제출되어, 2025년 4월 1일 채택되었고, 상원 역시 2025년 6월 18일 제안된 법률안을 일부 수정하여 만창일치로 채택하였다. 그 내용을 살펴보면, 성폭력은 동의 없이 범해진 모든 성적 행위이고, 이때 동의는 자유롭고(libre), 충분한 정보에 기반하여 명확하며(éclairé), 구체적이고(spécifique), 사전적이며 (préalable), 철회 가능한(révocable) 것이다. 동의는 맥락을 고려하여 평가되고, 피해자의 침묵이나 저항의 부재로 추론될 수 없으며, 성적 행위가 폭행, 위력, 협박, 위계에 의해 행해진 경우에는 동의가 없다. 프랑스의 비동의 간음죄 도입의 의미는 강간 문화를 자유로운 동의 문화로 대체하고, 이를 통해 평등과 존중이라는 사회적 가치를 실현하고자 하는 것이고, 이를 통해 형법의 처벌기능, 보호기능, 표현기능을 회복하고자 하는 것이다. 한국도 프랑스와 같이 비동의 간음죄를 도입함으로써 성적 행위를 하는 당사자는 상대방을 성적 대상화하지 않고, 성적 행위가 양 당사자의 충분히 이해한 자유로운 상태에서 상대방의 의사를 적극적으로 확인하고 존중하는 주고받음 속에서 이루어져야 하며, 이를 통하여 존중과 평등 문화가 실현될 수 있어야 한다.

Looking at its contents, sexual violence is all sexual acts committed without consent, and consent at this time is free, clear, specific, dictionary, and retractable. Consent is evaluated by considering the context, cannot be inferred from the victim's silence or absence of resistance, and there is no consent if the sexual act is committed by assault, power, intimidation, or surprise. The meaning of France's introduction of non-consensual sexual offences is to replace the rape culture with a culture of free consent, thereby realizing the social value of equality and respect, and to restore the punishment, protection, and expression functions of the criminal law. In Korea, like France, by introducing the crime of non-consent sexual offences, the parties who engage in sexual behavior should not objectify the other party, but actively confirm and respect the other party's intentions in a free state understood by both parties, and through this, a culture of respect and equality should be realized.
