공무원의 직무상 불법행위로 피해를 보거나, 도로·하천 그 밖의 공공 영조물의 설치·관리상 하자로 손해가 생긴 경우, 국가나 지방자치단체를 상대로 소송을 제기하지 않고도, 국가배상심의회에 그 배상을 신청할 수 있다(국가배상법 제2조, 제5조). 그러나, 현재 배상심의회는 낮은 인용율, 과소한 배상기준, 처리 지연, 절차 홍보의 미흡, 위원 구성의 비효율성, 불명확한 시효 규정 등 문제들로 인하여 기능을 제대로 발휘하지 못하고 있다고 생각된다. 이 글에서는 국가배상법에 대한 주요 논의 사항 및 배상심의회의 특성·한계 등에 대해 짚어보고, 대다수 지방자치단체가 배상책임보험(공제)에 가입하여 효율적으로 위험을 관리하는 점에 착안하여, 그 실질적 대안으로, 민영 손해보험사에 국가배상법 제5조 소정의 공공 영조물책임에 해당하는 사건을 위탁하여 처리하는 방안을 제시하고자 한다. 이를 통해, 실무 전문가에 의한 신속한 손해액 및 배상금 산정이 가능하게 되면, 배상심의회는 난이도 있는 분쟁 사건에 집중할 수 있을 것이다. 국가배상심의회는 진정한 행정형 ADR로서 그 설립 목적에 맞게 분쟁을 효과적으로 해결하고, 국민의 복리 증진을 위해 기여할 수 있도록 운영되어야 한다.

If individuals suffer damages due to illegal acts by public officials or defects in public facilities, they can apply for compensation from the Government Compensation Council without filing a lawsuit against the state or local governments. However, the Council is currently seen as ineffective due to issues such as a low acceptance rate, insufficient compensation standards, prolonged processing times, inadequate public awareness of application procedures, unreasonable board composition, and unclear regulations regarding the statute of limitations for state compensation claims. This paper will first address the major discussions under the State Compensation Act and the shortcomings of the Government Compensation Council in adequately redressing citizens’ grievances. Drawing on the efficient risk management of local governments through liability insurance, this paper proposes a practical alternative: entrusting private insurance companies with cases under the public facility liability specified in Article 5 of the State Compensation Act. This approach would enable prompt assessment of damages and compensation by professionals, allowing the Council to focus on complex cases. The Government Compensation Council should operate as a true administrative ADR (Alternative Dispute Resolution) mechanism, effectively resolving disputes and contributing to public welfare.
