본 연구는 근래 규제개혁의 핵심적인 용어로 대두되고 있는 그림자규제의 개념화와 유형화를 시도하고, 이를 바탕으로 그림자규제에 대한 실태조사와 일반국민 대상 설문조사를 수행하여, 향후 그림자규제관리의 정책적 제언을 하고자 한다. 본 연구는 그림자규제를 “국민과 기업에게 과도한 (권리를 제한하고 의무를 부담시키는) 부담을 주는 것으로 정부의 관리가 필요한 정부의 불합리한 개입 관행”으로 정의하고, 협의, 광의, 최광의 스펙트럼을 가지는 것으로 개념화하였다. 이렇게 보면 그림자규제는 재량일탈 행정지도(협의의 그림자규제), 미등록 행정규제, 유사 행정규제, 재량일탈(남용) 등록행정규제(불합리한 행정규제)를 포함할 수 있다. 이를 실증적으로 분석하기 위해, 경제단체에서 매년 정부를 상대로 요구하는 규제개혁 건의안의 규제개선 건의를 대상으로 실태조사와 일반 국민을 대상으로 한 설문조사의 결과, 협의의 그림자규제 뿐만 아니라 광의의 그림자규제까지도 규제관리의 대상으로 포함하여 인식하는 것으로 나타났다. 따라서 앞으로 좀더 명확한 그림자규제 세부 유형을 구분하여 정책대응을 할 필요가 있다.

This study attempts to conceptualize and typology of Shadow Regulations, which have emerged as a key term for regulatory reform in Korea. And based on this, it is intended to conduct a survey on the actual condition of Shadow Regulation in Korea and a survey of the general public to make stagnant suggestions for the management of Shadow Regulation in the future. This study defines Shadow Regulation as "the government's unreasonable intervention practice that requires government management as excessive(limiting rights and bearing obligations) burden on the people and companies," and conceptualized it as having diverse spectrum. In this way, Shadow Regulation can include discretionary administrative guidance unregistered administrative regulation, similar administrative regulation(private self regulation), and discretionary(abuse) registered administrative regulation(irrational administrative regulation). To empirically analyze this, it was found that economic organizations and the general public of Korea included not only the Shadow Regulation of minimum meaning but also maximum meaning as the subject of regulatory management. Therefore, it is necessary to respond to policies by classifying diverse types of Shadow Regulation in the future.
