문재인 정부 시절, 폭등하는 부동산으로 인해 부동산을 이용한 투자에 대한 붐이 불었었다. 2024년 현재는 과거에 비해 부동산 가격이 어느 정도 안정을 찾아가고 있지만 아직도 부동산은 자산에서 가장 중요한 부분을 차지하고 있으며, 부동산 투자를 통한 자산 증식을 꿈꾸는 사람들이 많은 것이 현실이다. 그러나 부동산에 대한 많은사람들의 관심에도 불구하고 아직도 부동산 중개계약은 과거의 계약 방식을 그대로 답습하고 있는 모습을 보이고 있다. 부동산 중개계약은 부동산의 특성인 개별성과 고정성으로부터 부동산시장을 추상화시킴으로써 부동산 거래에서 중개업자의 도움을 필요로 하고 있다. 부동산 거래의 시작은 중계계약에 있다. 이는 부동산 중개계약과 관련한 논의들이 계약의 의의, 종류, 법적 위치에 관한 다양한 법적 성질에 의해 여러 측면에서 이루어졌음을 의미한다. 이에 부동산 중개계약에 대한 법적인 측면에서 부동산 중개계약에 대한 문제점을 살펴본 후, 입법적 개선 방안을 제시하는 것을 목적으로 한다. 부동산 중개계약의 문제는 법적으로 중개계약을 어떠한 관점에서 보는가에 따라서 차이를 보이고 있다. 그렇지만 부동산 중개계약에서 사고가 발생하면 중개대상물에 대한 의무나 법적 책임 문제에 관하여 법과 현실에서는 일정한 차이가 존재한다. 이처럼 부동산 거래와 관련한 법과 현실의 차이가 늘어가는 시점에서 근본적으로 부동산 거래의 안정화와 활성화라는 측면에서 부동산 중개계약의 해결 방안을 찾는 노력이 필요하다.

Real estate brokerage contracts require the help of brokers in real estate transactions by abstracting the real estate market from the individuality and fixation, which are characteristics of real estate. The beginning of the real estate transaction is in the relay contract. This means that discussions related to real estate brokerage contracts have been conducted in various aspects due to the various legal characteristics of the significance, type, and legal location of the contract. Therefore, the purpose is to examine the problems with brokerage contracts in terms of the legal aspect of real estate brokerage contracts and to present legislative improvement measures. The problem of brokerage contracts differs according to what perspective the brokerage contract is legally viewed from. However, when an accident occurs in a real estate brokerage contract, there is a certain difference in law and reality regarding the issue of obligations or legal responsibility for the brokerage object. At a time when the difference between laws and reality related to real estate transactions is increasing, efforts should be made to find a solution to brokerage contracts in terms of stabilizing and revitalizing real estate transactions.
