이 글은 ‘부작위에 대한 정당방위’에 관한 몇 가지 불명확한 문제들을 세부적으로 검토해 보려는 시도이다. 현재 관련 문헌의 정당방위에 대한 서술에서는 거의 예외없이 ‘부작위에 의한 침해’가 가능하고, ‘부작위에 대한 정당방위’도 가능하다고 한다. 과연 그러한 것인지를 검토해 보기 위해 이 글에서는 우선 현재 국내의 관련 논의를 정리하고(Ⅱ), 부작위에 대한 정당방위에 있어서 과연 무엇이 문제된다는 것인지를 구체화하기 위해서 독일에서의 논의를 비교법적 관점에서 몇 부분 선별해서 다루어 보고(Ⅲ), 그렇다면 우리 형법에 고유한 부작위에 대한 정당방위의 해석은 가능한 것인지, 가능하다면 부작위에 대한 정당방위는 어떤 형식과 내용을 갖는 것인지를 살펴보면서 관련 논의의 단초를 마련해 보고자 했다(Ⅳ). 작위와 부작위의 구조차이에도 불구하고 형법 제21조의 정당방위는 작위뿐만 아니라 부작위에 의한 침해도 그 대상으로 하는지, 부작위도 침해에 해당한다고 한다면 방위행위의 방식으로는 어떤 유형이 가능한 것인지, 그러한 모든 유형이 정당방위의 형태인지, 진정부작위와 부진정부작위범에서 부작위에 대한 정당방위는 동일한 구조를 가지는 것인지, 부작위에 대한 정당방위가 작위의무자의 행위를 강요하는 형태가 된다면 상당성의 판단기준은 작위에 대한 정당방위와 동일해도 되는 것인지를 비교법적 검토를 아울러 살펴본 결과, 부작위에 대한 정당방위가 가능하다는 지배적인 입장의 자명성은 그 분명한 근거를 찾을 수 없고, 보다 정치한 논의가 필요해 보인다.

Self-defense is a long-standing defense not only in English and German Law, but also in Korean law. Professors in Korea and Germany believe that self defense is possible not only against act but also against omission. In the typical version of self-defense, the force is used against the attacker because his act creates the danger to other people's lives, properties, and so on. But the self-defense against omission is actually not the same as self-defense against the act. In the case of omission, the force is used against the guarantors because his omission can’t protect legal interests, in another word, his omission is to be punished as a crime. In this article the author tries to establish what is the difference between self-defense against act und self-defense against omission. In the current situation of scientific discussion in Korea and Germany, it is hardly surprising that self-defense is possible not only in the “echtes Unterlassungsdelikt”, but also in the “unechtes Unterlassungsdelikt”. With respect to these problems, this paper tries to clarify what is the critical problem in current discussion with respect to the self-defense against Unterlassen.
