실천철학에서 오래도록 받아들여져 온 한 근본 원리에 따르면 규범적 요구는 ‘능력’에 의해 제한을 받는다. 즉, 규범은 수행 가능한 행위만을 요구하고, 따라서 수행이 불가능한 행위는 규범에 의해 요구되지 않는다. 이러한 생각은 전통적으로 ‘당위는 수행가능성을 함축한다(Ought Implies Can, 즉 OIC)’는 이름의 원리를 통해 표현되어 왔다. 그런데, 최근 여러 철학자들에 의해 수행되고 있는 실험철학적 연구는 이 원리를 의심할 만한 흥미로운 실험 결과들을 보고하고 있다. 그에 따르면, 많은 일반인들은 수행불가능한 행위에 규범을 귀속시킴으로써, 적어도 겉보기에, 이 원리와 상충하는 판단을 내리는 것으로 관찰된다. 본 논문은 최근 보고되고 있는 이러한 실험철학적 연구 결과를 비판적으로 검토하고 분석한다. 그리고 그를 통해, 해당 연구자들이 실험 결과를 어떤 면에서 잘못 해석하고 있는지, 그리고 그에 대한 올바른 해석이 무엇인지 제시하고자 시도한다. 이를 위한 과정에서, 규범 진술에 대한 정당성 평가와 적절성 평가가 구별되어야 한다는 것이 중요하게 논의될 것이다. 결론적으로, 본 논문은 최근 소개되고 있는 실험철학적 연구 결과들은 OIC 원리를 논박하는 경험적 근거로 간주될 수 없다는 것을 드러낼 것이다.

According to a fundamental idea in practical philosophy, deontic norms are restricted by abilities in such a way that actions that cannot be carried out are not required by deontic norms. In other words, deontic norms only require actions that can be carried out. This idea has traditionally been expressed through a principle named ‘Ought Implies Can’. This principle, however, has recently been challenged on empirical grounds by researchers who are doing experimental philosophy. According to their report, many ordinary people are observed to make judgments that contradict this principle by attributing deontic norms to actions that cannot be carried out. In this article I critically review and analyze the reported experiments and results thereof. It will allow me to show in what ways the researchers are mistaken in interpreting the results and to suggest what the correct interpretation is. In so doing, attentions will be drawn to the distinction between evaluation of justification and evaluation of legitimacy when judgments are made on normative statements. In the end, it will be revealed that the empirical data that the researchers reported cannot be regarded as empirical evidence to refute the ‘Ought Implies Can’ principle.
