사우디아라비아 저작권법은 1989년 최초로 제정된 이래 2018년 개정된 법률이 현재까지 적용되고 있다. 사우디아라비아는 국제조약과 관련하여 베른협약, TRIPS 및 마라케시 조약에 가입하였으나 인터넷 환경 등에 대비하는 법안이 미흡하여 2018년 지식재산청의 발족을 필두로 지식재산권법에 대한 대대적인 정비가 진행되었고 그 성과로서 2018년 저작권법이 개정되었다. 특히, 국가적 난제를 해결하기 위해 정치, 경제, 사회 전반에 대한 대대적 개혁정책인 ‘Vision 2030’을 선포하면서 대한민국과 협력하여 지식재산 생태계 조성사업을 활발히 진행하는 등 지식재산권법의 전방위적인 체제개선을 추진 중이다. 사우디아라비아의 종교적, 정치적, 문화적, 사회적 여건은 저작권의 발전을 저해할 수 있는 열악한 환경이지만, 무형자산인 지식재산권의 중요성을 인식하기 시작하면서 현재 국가의 모든 역량을 집중하여 시행 중인 개혁정책과 더불어 국가 지식재산의 근간을 세우고 구체적인 정비작업에 돌입한 한편 혁신과 창작에 부합하는 지식재산 생태계 조성에 심혈을 기울이고 있다. 이러한 기조를 지속적으로 유지한다면 사우디아라비아 저작권의 미래는 매우 밝을 것으로 전망한다. 최근 네옴시티 건설과 이에 수반하여 여러 사업의 수행과 관련하여 향후 GCC 회원국인 중심축인 사우디아라비아와 저작권 협상을 진행해야 할 수도 있는 바, 사우디아라비아의 저작권을 일목요연하게 살펴보는 것은 비교법적으로도 의미가 있다고 생각한다.

Saudi Arabia's copyright law was first enacted in 1989, and the 2018 amendments are still in effect today. In terms of international treaties, Saudi Arabia is a signatory to the Berne Convention, TRIPS, and the Marrakesh Treaty, but there was a lack of legislation to prepare for the internet environment, so in 2018, a major overhaul of intellectual property laws was carried out, including the establishment of the Intellectual Property Office, and the Copyright Law was revised in 2018 as a result. In particular, the kingdom has declared 'Vision 2030,' a major reform policy for politics, economy, and society to address national challenges, and is actively promoting a project to create an intellectual property ecosystem in cooperation with the Republic of Korea. Although Saudi Arabia's religious, political, cultural, and social conditions are inhospitable to the development of copyright, the country has begun to recognize the importance of intellectual property as an intangible asset and is currently focusing all of its efforts on the reform policy, laying the foundation of the country's intellectual property and carrying out specific projects, as well as creating an intellectual property ecosystem that is conducive to innovation and creation. We believe that the future of copyright in Saudi Arabia will be very bright if the government continues to maintain this momentum. In light of the recent construction of Neom City and its accompanying projects, it may be necessary to conduct bilateral FTA negotiations with Saudi Arabia, the centerpiece of the GCC, in terms of copyright protection in the future, so it is meaningful to take a glance at copyright system in Saudi Arabia from the perspective of comparative law.
