법의 형식적 지배를 주장하기 이전에 여성에 대한 동등한 법적 권리의 보장은 정의로운 법의 지배의 기초가 될 것이다. 그러나 현대 사회에서도 여성의 법적 권리보장과 법적 중립성은 꾸준한 투쟁을 거쳐서야 보장되었다. 존 스튜어트 밀은 다수의 폭력에 반대하고 개인의 자유를 강조하는 진보적 자유주의자로서, 자신의 자유주의 이론을 보편적 인간에게 뿐만 아니라 여성에게도 동일하게 적용하고자 하였다. 그래서 그는 근대 자유주의 페미니스트의 대표하는 사상가로도 평가받고 있다. 밀은 사회와 가정 속 모든 영역에서 여성이 평등한 법적, 사회적 권리를 누려야 한다고 주장했다. 자유주의 페미니즘 역시 여성이 법적인 차별을 받지 않고 남자와 동등한 권리를 보장받아야 한다고 한다. 이러한 입장에서 차별적인 법의 폐지를 강력히 주장하게 되었고, 법 앞에 평등한 대우를 주장하는 여성의 목소리가 설득력을 얻게 되었다. Reed v. Reed 사건과 Stanton v. Stanton 사건 등에서 보듯이 지금은 너무나 당연하게 여겨지는 권리가 지속적인 사회적 법적 투쟁을 통해 이룩한 결과물임을 확인할 수 있다. 사회 속의 편견과 차별을 비판하면서 법을 통한 개혁의 기초를 제공한 자유주의 이론과 자유주의 페미니즘은 근현대 사회변혁의 초석이었고, 인류 역사에 큰 의미를 남겼다 하겠다.

Many discriminatory laws have been abolished through the liberal reforms based on liberal theory and liberal feminist theory, and this theory and movement has been the cornerstone of legal changes and was of great significance in the history of mankind.
