본 논문은 CCTV녹화물의 설치 요건 및 그 증거능력에 대한 독일 법규 및 판례, 학계의 입장을 살펴본 후, 관련 우리나라 법규 및 판례와 비교ㆍ검토하였다. 비교법적 검토 결과 우리나라의 경우에도 입법론적으로 형사소송법이나 경찰법, 집회법 등 개별 법률에서 그 취지에 맞추어 CCTV 등 영상정보처리기기의 설치요건에 관해 보다 명확하게 규율함으로써 법집행자 및 사법기관의 자의적인 판단영역을 줄이거나 개인정보보호법의 관련 규정을 보다 섬세하고 규율함으로써 개인의 사생활 등 인권보호를 강화할 필요성이 있음을 지적하였다. 더불어 CCTV녹화물의 증거능력과 관련하여 독일과 달리 우리나라의 경우에는 제한적으로나마 통신비밀보호법이 적용되는 경우를 제외하고는 CCTV녹화물의 증거능력에 관해 직접적으로 규율하고 있는 법규가 없는데, 앞으로 CCTV녹화물의 증거능력에 대한 학계의 깊은 관심과 활발한 논의가 절실함을 피력하였다.

This article examines the laws of the establishment and operation of CCTV (closed circuit television) and the exclusionary rule on CCTV recordings in Germany and illustrates some of the differences between the CCTV regulations in Germany and Korea. The establishment and operation of CCTV in Germany are regulated separately by diverse laws such as the Code of Criminal Procedure, the Police law, the Data Protection Act, and the Assembly Act. The Code of Criminal Procedure in Germany also has the evidence rule of the CCTV recordings based on section 103c in the Code of Criminal Procedure and the Police Law. The evidential admissibility of CCTV recordings based on the other laws or by a private individual are determined by the basic system of exclusionary rules founded on constitutional principles and statutory provisions. Such a separated and detailed regulation system governing the CCTV and the exclusionary rules in Germany could effectively protect human rights ― such as the privacy right and self-determination right of information. The German system could therefore serve as a good model for improving the Korean Personal Information Protection Law pertaining the only regulation of CCTV in Korea.
