본 논문에서는 2017년 제정된 룩셈부르크의 우주자원법의 입법적 구조와 주요 내용들을 살펴 보았다. 우주자원법은 룩셈부르크 정부의 우주자원 산업에 관한 국가정책 수립 이후, 정부가 주도적으로 작성ㆍ논의ㆍ발의한 법률로서, 우주자원의 소유권 취득을 허용하는 규정을 담고 있다는 점에서 국제적으로 상당한 논란이 되고 있다. 룩셈부르크 우주자원법은 우주자원의 탐사 및 이용을 장기적인 국가정책의 일환으로 지정하고, 그러한 관점에서 우주자원개발에 대한 인허가 정책, 관리감독 정책, 책임 및 보험 등을 정하고 있다. 전반적으로는 우주자원개발에 관한 사업허가 및 관리감독 규제 중심의 법률 체계라 할 수 있다. 최근, 우리나라 정부 역시 New Space Economy 시대를 맞아, 민간 우주 스타트업에 대한 투자 강화를 위한 우주경제 펀드를 조성한다고 밝힌바 있고, 우주비즈니스들에 대한 구체적인 산업정책들도 수립되고 있는 실정이다. 다만, 우주산업에 대한 정책수립과 개발에 관한 정부투자 의지가 여전히 적은 것도 사실이다. 다른 선진국에 비해 우주산업 예산은 현저히 적은 편이고, 민간 우주기업도 손에 꼽을 수준이다. 이점에서, 우주비즈니스에 대한 룩셈부르크 정부의 정책 방향과 법제 구축 현황이 일정한 시사가 될 수 있을 것으로 보인다. 룩셈부르크 우주자원법과 같은 선도적인 입법 추진에 관한 포괄적인 논의가 필요한 시기라고 생각한다.

The law of 20 July 2017 on the exploration and use of space resources (the Space Resources Law), as adopted by the Luxembourg Parliament on 13 July 2017 and effective from 1 August 2017. This paper looks at the legal framework and main contents of Luxembourg Space Resources Law of 2017. The Space Resources Law is a one of so-called industrial legislation that the Luxembourg government took the lead in drafting, discussing, and proposing after the establishment of a national policy on the SpaceResources.lu Initiative. However, it is internationally controversial in that it contains regulations allowing the ownership of space resources. The Space Resources Act designates the exploration and use of space resources as part of a long-term national policy, and from that point of view, it establishes licensing policies, authorizations, management and supervision policies, liability and insurance for space resources development. Recently, the Korean government also announced that it will create a space economy fund to strengthen investment in private space startups in the era of the New Space Economy. In this regard, the Luxembourg government’s policy direction and current status of establishing legislation for the space business can provide some implications.
