본 글의 목적은 두 가지이다. 하나는 법의 ‘표현적 기능’에 대한 탐구이다. 통상적으로 법에 규범력을 부여하는 통로는 첫 번째로 처벌에 대한 두려움, 두 번째로는 민주적 정통성에 대한 존중이다. 다만 근래에는 법률이 가지는 ‘표현적 기능’이 조명을 받고 있다. 즉 법률의 문헌과 그 속의 상징적 개념이 사회 구성원으로 하여금 특정 문제와 그에 대한 해결 방안의 방향성을 포착하여, 여기에 맞추어 자신의 삶을 영위할 수 있도록 유도하는 효과를 유발한다는 것이다. 이러한 견해는 법률이 가지는 사회적 규범의 창설과 확장에 대한 새로운 관점을 제공할 잠재력을 가진다고 판단되는 바, 검토해 봄직하다. 두 번째 목적은 앞에서의 논의에 터 잡아 「기후위기 대응을 위한 탄소중립·녹색성장기본법」의 표현적 기능을 원활화하는 데 있다. 이를 통하여 법의 표현적 기능에 대한 실증적 이해를 넓힘과 동시에, 탄소중립기본법을 둘러싼 오해를 불식시키고, 궁극적으로는 우리 사회가 한 발 더 지속가능한 방향으로 나아가기 위한 토대가 되리라 기대한다.

This article has two purposes. One is to explore the “expressive function” of law. Traditionally, the normative force of law is conveyed through two channels: first, fear of punishment, and second, respect for democratic legitimacy. In the meantime, however, the expressive function of law has been recognized as the law and its symbolic concepts have the effect of inducing members of society to recognize the social orientation toward certain problems and solutions, and to conduct their lives accordingly. This view has the potential to provide a new perspective on the creation and expansion of social norms through law, and is therefore a thesis worth examining. The second objective is to facilitate the expressive function of 「Framework Act On Carbon Neutrality And Green Growth For Coping With Climate Crisis」. In doing so, it is expected that it will broaden the understanding of the expressive function of the law, dispel misunderstandings surrounding the Act, and ultimately lay the foundation for our society to move forward to a more sustainable direction.
