대법원은 2022년 한 해에도 복잡다기한 민사 분쟁에 관해 중요한 판결들을 다수 선고하였다. 이 논문에서는 2022년에 선고된 중요 민사 판결 내지 결정(이하 합쳐서 “판결”이라고 한다) 중 민법총칙/물권법 관련 판결(5건), 채권법 관련 판결(6건), 가족법 관련 판결(3건) 등 모두 14건의 판결들을 분석하였다. 이 판결들은 채권에 대한 근질권과 전부명령의 상호관계, 관습법상 법정지상권의 효력, 구분소유자 아닌 대지지분권자의 부당이득반환청구, 소멸한 저당권에 기한 임의경매에 따른 부동산 취득의 효력, 비법인사단의 명칭에 대한 법적 보호, 수증자의 범죄행위와 증여계약의 해제, 산재보험급여 공제와 과실상계의 선후, 이혼 후 비양육친의 미성년자 감독의무, 손해배상예정액 감액 규정의 위약벌 유추적용 여부, 채권자대위권과 무자력 요건, 위헌·무효인 긴급조치로 인한 국가배상책임, 부담부 유증과 유류분 부족액 산정방법, 유책배우자의 이혼청구와 상대방의 혼인계속의사, 미성년 자녀를 둔 성전환자의 성별정정 등 다양한 쟁점들을 담고 있다. 각 판결에 대해서는 사실관계, 판결의 내용을 소개한 뒤 필자의 분석을 덧붙였다.

The Supreme Court of Korea addressed diverse legal issues in numerous civil cases in 2022. Against this backdrop, this paper reviews fourteen significant Supreme Court decisions in the realm of civil law. These decisions address the following issues: relationship between geun-pledge on a claim and a compulsory assignment order on the same claim, legal effect of customary superficies, unjust enrichment claim by a co-owner of the land for condominium building, legal effect of an auction process initiated by extinguished mortgage, legal protection on the name of an unincorporated entity, revocation of a gift contract due to recipient’s crime, sequence between deduction of worker’s compensation and comparative negligence, legal obligation of a non-rearing parent after divorce to supervise a minor child, analogical application of ex officio deduction of liquidated damages provision to penalty, subrogation right of a creditor and the insolvency requirement, state liability due to unconstitutional and invalid emergency measure by a president, conditional bequest and calculating legal reserve of inheritance, determination of a willingness to continue marriage relationship in the case of a divorce lawsuit by a blameful spouse, legal recognition of gender revision of a transgender who has a minor child. I have introduced facts and rulings of each case and added my own legal analysis.
