제4차 산업혁명의 기술적 발전과 함께 전 세계적인 화두로 등장한 뉴 스페이스 시대는 세계 우주산업의 개발양상을 기존 ‘정부-軍 주도 우주개발과 활용’에서 ‘민간-기업 주도 우주개발과 활용’으로 변화시켰고, 이를 통해 각국은 우주공간을 하나의 산업군으로 성장시켜 경제 성장을 도모하는 한편, 군사적으로도 우주공간을 선점하여 전략적인 전장으로 활용할 의도를 보이며 국제사회에서의 우주안보 위협을 점차 현실화시키고 있다. 따라서 향후의 우주안보 위협은 우리에게도 비군사의 영역과 결합된 복합적인 형태로 전개될 개연성이 있는데, 우리의 「우주개발 진흥법」, 「방위사업법」, 「통합방위법」 등의 제도적 대응체계 관련 법령은 사실상 ‘과학기술 개발’의 측면에서 발전되어 왔기 때문에 ‘군사적인’ 관점에서의 연구와 논의는 미흡하였다. 특히, 국내의 우주안보 위협 대응체계는 법률적으로 ① 범부처 협업체계 모호 ② 우주안보정보수집의 분산 ③ 방위사업 업무의 ‘제도적 칸막이’ ④ 우주영역에 대한 통합방위 작전수행의 근거 부재 등의 제도적인 취약점이 식별될 여지가 있다. 본 연구는 이러한 관점에서 민간과 軍이 협력하여 국방우주력이 발전되는 뉴 스페이스 시대에 국내의 우주안보 위협 대응체계는 개선될 필요가 있고, 단기적으로 앞서 살펴본 법령들의 한계점을 정비하며, 장기적으로는 민ㆍ관ㆍ軍 협력의 중심이 될 전담 군사조직 편성 방향을 제시하여 우주안보 문제의 해결방안을 탐색하였다.

The advent of the New Space era, with technological development of the 4th Industrial Revolution, the global space industry is changing its paradigm from "space development focused on government-military" to "space development focused on private enterprise". And this phenomenon aims to contribute to the economic growth of each country, and the threat of security through space is becoming a reality, as it could be used as a new strategic battlefield environment. Therefore, the future threat of ‘space security’ is likely to develop in a combination of military and non-military areas. But our response systems such as “Space Development Promotion Act”, “Defense Acquisition Act”, “Integrated Defense Act” have the limitations Since it has been developed in terms of 'development of science and technology', research and discussion from a 'military' perspective have been insufficient. In particular, our Space Security threat response system has following legally weaknesses : ① ambiguous government cooperation system ② distribution of space security intelligence collection ③ institutional partition during defense acquisition work ④ absence of basis for performing integrated defense operation. This study originated from the consciousness that domestic space security threat response system is necessary to be developed in the era of New Space. So in the short term, the weaknesses of the laws should maintenance, and in the long term, presenting for organizing a specialized military organization that will be the center of private enterprise, government, and national defense.
