본 연구는 사법부의 결정을 정책과정으로 볼 수 있는지에 대한 질문에서 출발한다. 특히, 최상위 사법기관인 헌법재판소 결정의 변화가 정책변동으로 이해될 수 있는지 이론적으로 고찰하고, 대표적 사례인 낙태죄의 헌법불합치 결정과정을 정책변동 모형을 통해 분석하였다. 구체적으로 옹호연합모형(ACF)과 이익집단위상변동모형(ICF)을 결합한 분석틀을 적용하여 기존 합헌에서 헌법불합치 결정으로 변동된 과정을 살펴보았다. 분석 결과는 크게 세 가지로 나누어 볼 수 있다. 첫째, 외적변수로써 정권교체에 따른 제도적 맥락의 변화로 낙태찬성입장이 우세하게 되었다. 또한 사회적으로 여성의 지위가 상승하였고, 국제사회의 움직임 역시 낙태를 지지하는 양상을 보이기 시작하였다. 둘째, 낙태찬성연합은 연합 내 구성원 간 동일한 신념체계를 공유하였고, 적극적 전략을 통해 헌법재판소의 결정이 변화할 수 있는 사회적 분위기를 조성하였다. 셋째, 헌법재판소 결정의 변화를 통해 옹호집단의 위상은 변화하게 되어 낙태찬성옹호연합은 위상이 상승한 반면, 낙태반대옹호연합은 위상의 쇠락이라는 결과를 맞이하게 된다. 이를 통해 낙태죄와 같은 도덕적 가치에 기반한 정책은 제도적, 사회적 변화을 기반으로 변동될 수 있으며, 헌법재판소는 정책중개자(policy broker)로써 정책변동을 유발하는 역할을 수행함을 확인 할 수 있었다.

This paper starts whether the judiciary’s decision can be understood as a policy process. In particular, it is to analyze the change of Constitutional court’s decision through abortion unconstitutional case in 2019. In detail, this study attempts to apply the combination of Advocacy Coalition Framework (ACF) and Interest Group Standing Change Framework (ICF) to examine the process change from constitutional to unconstitutional. The analysis results can be largely divided into three categories. First, the establishment of a progressive government following regime change has led to the prevailing position in favor of abortion. In addition, the status of women has risen and the movement of the international society has also begun to support abortion. Second, the alliance for abortion shared the same belief system among members and created a social atmosphere in which the decisions of the Constitutional Court could be changed through diverse strategies. Lastly, the status of the advocacy group changes through Constitutional Court’s decision, resulting in the rise of the status of the pro-abortion alliance, while the anti-abortion alliance faces a decline in status. This study implies that policies based on moral values such as abortion are changed based on institutional or social influence, and the Constitutional Court plays a role as a policy broker in policy process.
