근대 유럽의 법전편찬(Kodifikation)은 자연법학과 역사법학 간의 논쟁의 주제이자, 칸트, 사비니, 헤겔의 법적 사유에도 주요하게 작용한 주제이다. 이에 대한 이해의 실마리를 제공하는 것으로 1779년 뮐러아놀드 소송과 1794년 프로이센 일반란트법(ALR)을 들 수 있다. 무엇보다 봉건적 구체제의 법분열 상태를 극복하고 근대적 통일법전을 편찬하는 것이 자연적-보편적 이성법과 계몽주의의의 요청이라고 주장했던 자연법학파와는 달리, 역사법학파는 민족정신과 법의 역사성을 토대로 하여 체계적인 판덱텐 법학 및 법학적 실증주의를 전개하였다. 이들 모두와 거리를 두었던 헤겔로서는, 근대의 입법-법전화는 단지 주관적이고 특수하게 현존하는 관행-관습에 객관적 외관형식을 부여하는 수집편찬의 의미가 아니라 근대 시민사회의 평등한 개인들의 욕구와 노동 및 소유관계에 제도적 보편성-명확성을 부여하고 규범적으로 승인한다는 의미를 지니며, 자연히 이런 입법은 노동 및 소유관계의 전개에 따라 지속적으로 상호적응-변화되어가는 역사적 맥락을 지닌 것임을 강조하였다.
해석과 평가의 다양성에도 불구하고, 사회사적-정치적 맥락 및 시대 정신의 작용 속에서 요구-실현되어간 근대의 법전편찬은, 사회계약론의 테마와도 이어지는 불가결한 인식, 즉 오직 도덕적으로 책임있는 근대국가의 구성원으로서, 권리를 지닌 윤리적-법적인 존재만이 진정으로 자유로울 수 있다는 인식에서 출발하여, 과연 그것이 어떤 수단-매개를 통해 촉진될 수 있는가에 대한 이념적이고 실재적인 대결 지점으로서 재음미될 수 있을 것이다.
Modern European Codification is the subject of the historical German Codification Debate between the Natural School of Law and the Historical School of Law. It also significantly influenced the legal thinking of Kant, Savigny, and Hegel. Müller-Arnold process in 1779 and the General State Laws for the Prussian States(ALR) of 1794 give an indication of this. Unlike the Natural School of Law, which considers the management of medieval feudalism and modern codification as a requirement of universal natural reason and enlightenment, the Historical School of Law has defended systematic Pandectistic jurisprudence and legal scientific positivism based on the folk spirit and the historicity of law.
Distanced from both, Hegel has believed that the modern codification programme has a historical context and significance to recognize the needs of individuals and their labor-property relationships and to give them institutional universality.
Despite the diversity of interpretation and evaluation, modern codification is based on the one hand on the recognition that only the ethical-legal being with rights as the morally responsible member of the modern state can truly be free, and on the other hand on the question of how it can be promoted. In this respect, modern codification is to be considered the ideological and realistic strugglepoint of new era.
