메타버스(Metaverse)와 대체 불가능 토큰(NFT)은 상호 기술적 융합을 통하여 신종 코로나바이러스 감염증(코로나19)으로 인한 팬데믹(전염병의 세계적 대유행) 현상으로 인한 공간대체의 필요성에 기반하여 기술적 성장을 주도하고 있다. IT전문가들은 메타버스가 신 국가성장동력이 될 것으로 전망하고 있고, 메타버스를 받쳐줄 핵심 산업·기술로서 대체 불가능 토큰, 즉 NFT(Non-Fungible Token)를 주목하고 있다.
메타버스 관련 산업이 지속적으로 성장하기| 위해서 제일 필요한 요소는 단연 온전한 경제활동을 보장할 수 있는 생태계를 조성하는 일이 될 것이다. 즉, 가상세계에서 활동한 나의 노력에 대한 대가가 나만의 소유권으로 인정되어야 함은 기본이고, 가상세계 속 나의 자산이 현실 세계에서도 통용되는 화폐로 전환될 수 있어야 한다는 전제 조건이 성립되어야 할 것이다.
2020년부터 이어진 코로나19의 영향으로 관광문화 예술계의 수많은 종사자가 경제적 어려움을 겪고 있는 지금, 메타버스의 가능성과 잠재력은 마치 구원 투수와 같이 경제계의 거인과 같은 존재로 부상하고 있다. 그 메타버스 안에서의 경제활동을 원활히 해줄 수 있는 매개체가 바로 NFT이다. 탈중앙 형태의 메타버스에서는 소유권을 증명해줄 주체가 없고, NFT가 이러한 역할을 대체하게 되며 메타버스 내에서 만들어진 UGC(user-generated content) 에 대한 소유권을 부여하고 거래가 가능해진다.
이 논문은 메타버스와 NFT의 기술적 융합에 대하여 경제생태계의 패러다임 변화의 관점에서 살펴보고, 또한 메타버스 시대의 가상경제와 가상자산을 중심으로 가상자산으로서의 NFT를 메타버스의 핵심적 기술로 연구하였다. 나아가 메타버스 관련 Legal Issues를 현재 시행되고 있는 지식재산권법, 게임산업진흥법, 개인정보보호법, 범죄행위 관련 Issues 등으로 개별적 검토를 하였고, NFT 관련 Legal Issues를 지식재산권법, 특정금융정보법, 자본시장법, 자금세탁 관련 Issues 등으로 나누어 검토하였다.
끝으로 메타버스와 NFT에 관한 입법방향은 국회에서 논의되고 있는 규제개선책의 일환으로 제시되고 있는 ‘임시기준’과 ‘자율규제’방안을 적용하여 네거티브 규제방식으로 획기적인 전환의 필요성을 강조하였다. 메타버스와 NFT산업은 앞으로도 무한한 가능성을 내포한 태동기의 상황에 놓여있다. 이러한 가상경제 생태계에서 새로운 규제를 만들어 새롭게 뻗어나가는 산업의 발목을 잡기 보다는 그 산업의 진흥을 위해 ‘네거티브 규제방식’의 입법이 바람직하다는 제언을 하였다.
Metaverse and non-fungible token (NFT) lead technological growth based on the need for space replacement due to the pandemic (global pandemic of infectious disease) caused by the novel coronavirus infection (COVID-19) through mutual technological convergence are doing IT experts predict that Metaverse will become a new national growth engine, and are paying attention to non-fungible tokens (NFTs) as core industries and technologies to support Metaverse.
For the Metaverse related industry to continue to grow | The most necessary factor for this will be the creation of an ecosystem that can guarantee sound economic activity. In other words, it is fundamental that the reward for my efforts in the virtual world should be recognized as my own ownership, and the precondition that my assets in the virtual world should be able to be converted into currency used in the real world must be established.
Now that many workers in the tourism, culture and art world are experiencing economic hardship due to the impact of COVID-19 that has continued since 2020, the potential and potential of Metaverse is emerging as a giant in the economic world, like a relief pitcher. The medium that can facilitate economic activities within the metaverse is the NFT. In the decentralized metaverse, there is no entity to prove ownership, and the NFT will replace this role, granting ownership of the UGC (user-generated content) created within the metaverse and making transactions possible.
This paper examines the technological convergence of metaverse and NFT from the perspective of paradigm change in the economic ecosystem, and also studies NFT as a virtual asset as a core technology of metaverse, focusing on the virtual economy and virtual assets in the metaverse era. Furthermore, legal issues related to Metaverse were individually reviewed according to the currently enforced Intellectual Property Act, Game Industry Promotion Act, Personal Information Protection Act, and criminal activity related issues, and NFT-related Legal Issues were classified into Intellectual Property Act, Specific Financial Information Act, and Capital Markets. Law and money laundering related issues were divided and reviewed.
Lastly, the legislative direction on Metaverse and NFT emphasized the need for a revolutionary transition to a negative regulatory method by applying the ‘temporary standards’ and ‘self-regulation’ measures, which are being proposed as part of the regulatory improvement measures being discussed in the National Assembly. Metaverse and the NFT industry are in a nascent stage with infinite possibilities in the future. It was suggested that legislation of a ‘negative regulation method’ is desirable to promote the industry rather than create new regulations in this virtual economy ecosystem to hold back the newly expanding industry.
