본 연구는 Newig의 입법분류모형과 다중흐름모형(Multiple Stream Framework)을 결합한 모형을 활용하여 강사법의 입법과 개정입법에 있어 상징입법화 과정의 동태성을 살펴본다. 이를 통해 강사법 입법 및 개정입법 과정에서 발생하는 상징입법의 양태 및 변화와 주요 쟁점을 살펴보고, 상징입법적 요소를 완화하기 위한 입법정책적 대안에 대해 시사점을 제시하고자 하였다. 분석결과, 2011년 1차 정책변동에서 상징입법적 요소가 강했던 강사법은 2018년 2차 정책변동을 거쳐서 상징입법적 성격이 완화되었다고 볼 수 있다. 이는 정권교체 이후 정부가 정책혁신가로서 주도적인 역할을 수행하고 대규모 자원을 투입함으로써 가능했던 것으로 보인다. 본 연구는 기존의 상징입법 연구에서 부족했던 입법과정의 동태성 분석과 기존의 다중흐름모형 연구에서 부족했던 입법평가 부분을 상호보완함으로써 입법과정에서 정책의 발전과정을 분석 및 평가할 수 있는 이론적 틀을 제시하였다.

This paper examines the dynamics of the symbolic legislation process of the legislation and amendment of the Instructor Act by combining Newig's legislative classification, and the Multiple Streams Framework. Through this process, specific features and changes of symbolic legislation that arise from the lawmaking and amendment of the Instructor Act are analyzed to present alternatives and implications to ease symbolic legislation. The results of our analysis show that the Instructor Act, which had strong symbolic legislative features after the first amendment in 2011, has experienced symbolic legislation mitigations after its second amendment in 2018. This was possible thanks to the leading role that the government has played as a policy innovator, as well as the large amount of resources it has allocated after the regime changed. This paper presents a theoretical framework to analyze and evaluate policy development of the legislative process, and complements the analysis of the dynamics of the legislative process and symbolic legislation, which lacked academia attention over the past years.
