본 연구는 최근 코로나 및 입시비리로 영향을 받고 있는 장애대학생의 교육권 실행 현황을 살펴보기 위해 관련 법령 및 장애인 고등교육지원 종합방안을 검토하였다. [장애인 등에 대한 특수교육법], [장애인 차별금지 및 권리구제 등에 관한 법률], [장애인 복지법], [고등교육법], [장애인·노인·임산부 등의 편의증진 보장에 관한 법률] 각 법률 중 장애대학생을 위한 지원 및 위반 시 제재 조항을 살펴보았으며 2022년 제3차 사회관계장관회의에서 교육부 장관이 발표한 장애인 고등교육지원 종합방안과 교육부의 2022년 대학의 장애학생지원센터 운영 지원사업 기본 계획을 검토하였다. 각 법률은 장애대학생 지원을 위해 편의제공 및 차별금지 등에 대한 내용을 포함하고 있으며 교육부는 범부처 협조를 요청하며 장애대학생의 교육권 실행을 적극 추진하기 위한 세부적인 계획을 발표하였다. 장애대학생 지원을 위한 법률과 2022년 교육부의 계획이 성공적인 실행이 되도록 인프라가 적절히 구축되어야 하며 구성원들의 협조가 필요하다.

The purpose of this study is to examine related laws and 2022 ministry of education plan to support college students with disabilities because covid-19 virus and university entering exam discrimination have influenced those population. To conduct the study, [Special Education Laws for Individuals with Disabilities and Others], [Act on the Prohibition of Discrimination against Persons with Disabilities Remedy against Infringement of Their Rights], [Act on Welfare of Persons with Disabilities], [Higher Education Act], [Act on the Guarantee of Convenience Promotion of Persons with Disabilities, Senior Citizes, Pregnant Women and Nursing Mothers] were reviewed, and the comprehensive plan of higher education for students with disabilities as well as special education support centers in college administration support plan for 2022 were analyzed. Each laws covers providing facilities and prohibiting discrimination against students with disabilities, and the ministry of education request department collaboration by announcing specific plans for students with disabilities. Infrastructure and each members’ collaboration are necessary to implement the laws and 2022 ministry of education plan to support college students with disabilities successfully.
