과연 밀이 주장한‘타인에 대한 해악’이란 무엇인가? 일반적으로 해악은 ‘나쁨’으로 정의되고 있으나, 그 의미와 정도에 관해 밀은 『자유론』에서 명시적으로 답하지 않고 있다. 또한‘타인’역시 실존하는 구체적 자연인으로서의 개인을 의미하는 것인지, 또는 사회구성원으로서의 추상적 인격체를 포함하는 개념인지에 관해 명확하게 드러나 있지 않다. 그러나‘해악의 원칙’의 적용 범위와 한계를 명확히 하는 작업은 그의 이론을 보다 충실하게 이해하는 데 있어 필수적이다. 따라서 본고는 ‘과연 타인에 대한 해악이란 무엇인가’라는 본질적인 물음에서부터 출발하여, 『자유론』에 관한 문헌적 해석을 통해 밀이 자유와 해악의 개념을 어떻게 다듬고 구체화시켜나가는지 살펴보았다. 특히 ① 해악의 구체성과 추상성 ② 작위와 부작위의 구분 ③ 타인의 범위의 모호성 ④ 보호가치 있는 개인과 그렇지 못한 개인이라는 네 관점에서 해악의 원칙의 의미와 범위를 명확히하고자 하였다. 조사 결과, 밀의 해악의 원칙에서의 자유는 ‘부재’로서의 자유만이 아닌, ‘실현과 성취’로서의 자유를 추구하고 있다는 점에서 적극적 자유의 요소를 융합하고 있는 것으로 보아야 함을 알 수 있었다. 원자화된 개인이 부유하는 사회가 아니라, 자유로운 개인들이 공론장에서의 토론을 통해 진리를 탐구하고 사회적 연대를 구축하는 사회야말로 밀이 『자유론』을 통해 구축하고자 했던 이상국가의 모습이기 때문이다. 그가 해악의 원칙을 통해 실현하고자 했던 질서에는 객관성과 이성을 토대로 한 목적론적 가치와 지향점이 담겨 있었다. 또한 이를 토대로 사실적시명예훼손죄의 법철학적 타당성을 검토해봄으로써, 표현의 종류를 세분화하여 각 단계에 대해 밀은 어떠한 판단을 내렸을지 예상해보고 오늘날 한국 사회의 자유의 현주소를 다시금 진단해보고자 하였다.

Although ‘harm’ is normally defined as simply‘badness’, the specific meaning and scope of ‘harm’ is not explained explicitly in his book. However, the effort of trying to clearly define the boundaries of ‘harm’ is an essential step in understanding the theory of John Stuart Mill. Thus, this paper has tried to analyze in detail the definition of ‘harm’, focusing on first, the concreteness and abstractness of the term, second, distinction between acts and omissions, third, the ambiguity of the scope of the word ‘other people’, and finally, the definition of individuals with protection value. As a result of the research, we have witnessed that ‘freedom’ in the book refers not only to ‘absence of control or external intervention’, but also to rather positive terms such as ‘realization and achievement’. The ideal society envisioned by John Stuart Mill was not one with individuals wandering with no interconnection or solidarity, but rather one where individuals can freely discuss their ideas in search of truth. Thus, it is essential to re-examine his theory in a more positive, or a more assertive aspect.
