가상·증강현실의 주요 특징 중 하나는 오버레이 기능, 즉, 배경 대상 위에 이미지 및 정보를 덧씌우거나 겹쳐 화면상에 표시하는 것이다. 가상·증강현실 내 오버레이는 오버레이 효과를 쉽게 분리, 변경, 종료하여 원본과 비교 감상할 수 있다는 점이 기존 덮어쓰기 방식과 다르다. 또한 증강현실 내 오버레이의 경우, QR코드 혹은 마커리스 인식 방식 등을 통하여 대상을 인식하기 때문에 인식 과정에서 대상에 대한 복제 및 저장을 수반하지 않는다. 가상·증강현실 내 오버레이에 등장하는 저작물의 종류와 보호 관련 법리는 다음과 같이 나눌 수 있다. ① 오버레이한 저작물(덧씌우기 및 겹쳐 표시한 저작물): 2차적저작물작성권, 공중송신권, ② 오버레이된 배경저작물(덧씌워진 배경 속 저작물): 일시적 복제, 부수적 이용, 동일성유지권, ③ 결합저작물(오버레이한 저작물과 오버레이된 배경저작물의 일체화된 모습): 결합저작물 성립여부이다. 이외 디자인보호법상 화상디자인 보호를 통한 오버레이할 저작물과 결합저작물의 보호, 부정경쟁방지법상 성과물 보호에 의한 배경저작물 보호 등을 모색해볼 수 있다. 또한 증강현실의 경우, 오버레이 적용 행위 보호를 위한 헌법상 표현의 자유, 배경 장소의 소유권자 및 거주자를 보호하기 위한 민법상 소유물에 대한 방해제거, 방해예방청구권 등을 적용하여 오버레이 행위 허용 여부를 검토하여 볼 수 있다. 현실 공간을 배경으로 오버레이를 하는 경우, 오버레이용 저작물에 대한 지식재산권 침해 문제 이외에도 장소 및 위치정보 이용상의 문제도 함께 고려하여야 할 것으로 생각된다.

Overlay feature would be one of the main characteristics of Virtual Reality and Augmented Reality. In VR and AR, images and information are overlayed on the background object. Overlays in VR/AR are easy to separate, change, or terminate the overlay effects. And the overlays in AR are functioned through scanning a QR code or markerless tracking, so it doesn’t involve reproduction or storage of the background object. The types of works of overlays in VR/AR and applicable laws are as below. (1) Overlaying works: adaptation rights and public transmission rights; (2) works in the overlaid background: temporary reproduction, incidental use, and right to the integrity; (3) integrated appearance of the overlaying work and the works in the overlaid background: right for composite work. In addition, protection for computer-generated graphic design(Design Protection Act) and protection for one’s achievements(Unfair Competition Prevention Act) can be applied. Also, to protect the owners and residents of the AR overlaid background places, freedom of expression(Constitution Law) and Removal and Prevention of Disturbance against Article Owned(Civil Act) could be applied. If the overlay features induce the outdoor activity, the matter of use and own the property should be considered along with the intellectual property issues.
