訟師는 狀師라고도 하며 소장을 대필하거나 소송을 대행하는 등의 업무를 담당했던 이들을 말한다. 오늘날의 변호사와 유사한 임무를 수행했다고 말할 수 있다. 송사의 시초라 할 수 있는 춘추시대 鄧析으로부터 시작하여 송사가 전업화된 송대를 지나 송사가 폭발적으로 증가한 명·청대에 이르기까지 송사는 세상의 변화에 적응하며 존재를 이어나갔다. 하지만 송사를 국가 법률 체제에 대한 도전으로 여긴 역대 왕조의 탄압과 화합을 주요 가치로 여기는 유가 사상의 영향, 그리고 전업화된 직업인으로서의 송사 간의 경쟁은 송사를 부정적으로 인식할 수밖에 없게 만드는 요인이 되었다. 이렇듯 송사에 대한 부정적인 인식은 송사를 칭하는 다양한 용어를 통해 확인할 수 있다. 하지만 송사가 역대 왕조의 탄압에도 불구하고 끝내 사라지지 않고 명맥을 유지하거나 일부 지역에서는 오히려 번성하기도 했다는 점은 의아하지 않을 수 없다. 여기에는 송사의 어떤 긍정적인 면이 작용한 것은 아니었을까? 따라서 본고는 송사에 대한 부정적 인식을 재고하여 송사의 긍정적인 면을 발견할 수 있으리라는 생각에서 시작되었다. 그리하여 그 실례를 문학작품 특히, 명청소설 속에 반영된 송사의 긍정적 인물형상을 통해 탐색해보았다. 명청소설 속 송사는 대개 부정적으로 그려진다. 그러나 자신의 본분을 지키며 남을 돕거나 자신의 능력을 바탕으로 정의를 실현하기도 하였으며 자신의 잘못을 뉘우치고 회개하는 긍정적인 모습을 보이기도 했다. 더욱이 민간설화에는 영웅으로 추앙받는 예도 있음을 확인할 수 있었다.

Songshi[訟師] is also called as Zhuangshi[狀師] and they are the people who is in charge of the work writing a complaint for a person or acting on behalf of a lawsuit, etc. It is called they worked similar assignment with the lawyer of today. Songshi continued their existence adapting to the changes in the world from Dengxi[鄧析] in the Spring and Autumn period which can be called as the beginning of Songshi and passing through the Song Dynasty which Songshi became a full-time business and till MingQing Dynasty which Songshi increased explosively. However, the suppression of all time dynasty considered Songshi as a challenge to national legal system, the influence of Confucian ideology considered the harmony as main value and the competition among Songshies as a full-time worker became a factor recognizing Songshi as negative. Like this, negative recognition for Songshi can be confirmed by various titles called Songshi. However, it can’t help wondering that Songshi continued to exist never fading away or rather flourished at partial region though there were the suppression of all time dynasty. Is it because there were certain positive aspect of Songshi? Therefore, this study was started from the thinking that positive aspect of Songshi can be found reconsidering negative recognition prevailed in traditional legal culture of China. So, the real example was searched by the positive image of Songshi reflected in the literary works, especially in the novels of MingQing Dynasty. Songshi in the novels of MingQing Dynasty is usually shown as negative. However, they helped others fulfilling their duty, realized justice based on their ability and showed positive aspect regretting and repenting their mistake. Furthermore, it was confirmed that they praised as a hero in a folktale.
