연구는 2021년 2월 프랑스 하원에서 가결된 일명 ‘분리주의 방지법안’의 제정 배경과 목적을 검토하는 데 있다. 2020년 10월 16일 이슬람 난민 청년에 의해 중학교 교사 사무엘 파티가 피살되자 프랑스 대통령 임마누엘 마크롱은 프랑스에서 발생하는 오늘날의 테러는 이슬람 분리주의에 의한 범죄라 선언한다. 이슬람 분리주의는 종교라는 명목으로 프랑스 공화국의 원칙과 법을 존중하거나 인정하지 않으면서 프랑스를 뒤흔들고자 하는 급진적 이슬람주의이다. 마크롱 정부는 2015년 샤를리 에브도 사건과 파리 동시다발 테러 사건부터 사무엘 파티의 참수 테러까지 이슬람 분리주의의 소행으로 판단한다. 그리고 분리주의에 대항하여 싸울 수 있는 대테러 법안을 국회에 제출하였다. 마크롱은 프랑스 무슬림 그리고 이슬람 협회들과의 갈등과 논란에도 불구하고 이 법안은 “공화국과 그 가치를 수호하고 평등과 해방의 약속을 존중하도록 하기 위한” 새로운 조치들이라고 설명한다. 법안은 2021년 3월 30일부터 상원에서 검토될 것이다. 프랑스에서 처음으로 등장한 이슬람 분리주의라는 용어에 대한 함의와 분리주의 법안의 출현 배경, 법안의 구성 내용 등을 검토하는데 본 연구의 가치와 의의가 있다.

This study is to examine the background and purpose on the enactment of the ‘anti-separatism bill’, which was passed by the National Assembly in Feb. 2021. On Oct. 16, 2020, when Samuel Paty, a middle school teacher, was killed by a young Muslim refugee, French President Emmanuel Macron declared that today’s terrorism in France is the crime caused by Islamist separatism. Islamist separatism is the radical Islamism that seeks to shake France without respecting the principles and laws of the French Republic in the name of religion. Macron government believes that Islamist separatists committed the Charlie Hebdo Affair, the Paris Terror Attacks in 2015 to the beheading of Samuel Paty. And the government also submitted the counter-terrorism bill on the fight against separatism to the French Parliament. President Macron announced that the bill is a set of measures that keeps the Republic’s values and respects the promises of equality and liberation despite conflicts and controversies with French Muslims and their associations. The bill will be reviewed by the Senate from Mar. 30. The value and significance of this study are to examine the implications of the term, Islamist separatism which first appeared in France, the background to the emergence of separatist laws and the composition of the bill.
