근래 몇 년 사이에 음식점과 카페 등을 중심으로 ‘노키즈존(no kids zone)’이 많이 늘어났다. 이러한 노키즈존은 찬반 논란에도 불구하고 현재 대도시는 물론 관광지를 중심으로 지속적으로 생겨나고 있다. 본 고에서는 아동의 권리 보장의 필요성, 노키즈존과 이에 대한 인식, 아동의 특수성, 다른 국가의 상황과 노키즈존에 관련된 여러 가지 문제점 및 헌법적 쟁점 등에 대해 고찰해 보았다. 우리 헌법 제11조는 “모든 국민은 법 앞에 평등하고, 누구든지 성별, 종교, 사회적 신분에 의하여 차별을 받지 아니한다.”고 규정하고 있다. 각 기본권 주체들 간의 이해관계와 기본권의 충돌 문제 및 여러 가지 쟁점들을 종합해 보았을 때, 이러한 노키즈존 문제에 대해서 사회 구성원 모두가 만족하고 행복할 수 있는 방법은 없을까 생각해보아야 할 시점이다. 가능하다면 궁극적으로는 사회통합을 위해 헌법상 규범적 조화의 원리에 기반하여 충돌하는 기본권들과 헌법적 법익들이 모두 실현될 수 있는 최선의 이상적인 상황으로 나아가야 할 것이다. 지금의 노키즈존 논쟁은 소모적인 싸움이 되어 가고 있지만, 근본적인 해결과 개선을 위해서는 먼저 다른 사람의 권리를 존중하고 상대를 배려하려는 노력이 필요하다. 그러기 위해서 각 기본권 주체들의 노력은 물론이고 사회와 국가 차원의 지원과 방안 마련이 함께 수반되어야 할 것이다.

In recent years, No kids zone has increased a lot, mainly in restaurants and cafes. Despite the controversy over the pros and cons, the no kids zone is continuously emerging as a tourist destination as well as a large city. This study examined the national feelings of the no kids zone and its characteristics, the situation of other countries, various issues related to the no kids zone, and constitutional issues. Article 11 of our Constitution stipulates that “all citizens are equal before the law, and no one is discriminated against by gender, religion, or social status.” When we put together the interests of each fundamental rights subject, the conflicts of fundamental rights and various issues, it is time to think about whether there is a way for everyone to be satisfied and happy about these no kids zone problems. If possible, it is necessary to move to the best ideal situation where both the fundamental rights and the constitutional interests that conflict based on the principle of constitutional normative harmony can be realized for social integration. The current no kids zone debate is becoming a wasteful battle, but in order to solve and improve fundamentally, it is necessary to first respect the rights of others and to consider their opponents. In order to do so, it is necessary to accompany the efforts of each fundamental rights subject as well as the support and plan of the society and the state.
