2020년 5월 28일 중국 제13기 전국인민대표대회 제3차 전체회의에서는 표결을 통하여 「민법전」을 통과시켰다. 이는 2021년 1월 1일부터 시행될 예정이다. 중국 민법전 상속 편은 중국의 현행 「상속법」과 그 사법해석을 일정한 규격에 맞게 정리한 것이다. 중국민법전의 체계에 따르면 상속 편은 내부적으로 상속제도의 기본원칙을 관철하여야할 뿐만 아니라, 외부적으로 민법전의 기타 각 편 예를 들면, 민법총칙, 물권 편과 계약 편 그리고 혼인가족 편 등과의 법적용 논란도 조율하여야 할 것이다. 그러나 본 편은 체계적인 면에서 단순히 법률을 한데 모아 편성한 흔적이 농후하고 내용면에서 사법실천에 있어서 효과적인 규정들을 폭넓게 받아들여 채택하지 않았으며 입법적인 가치이념에서도 21세기 현대 상속법의 흐름을 제대로 반영하지 못하였다. 사회가 발전함에 따라 현대 민법은 상속법을 포함하여 일련의 변화를 가져왔으며, 현대 상속법의 가치이념도 시대정신을 반영하여 시대적 특징을 지녀야 한다. 국가에 따라 구체적인 상속제도 뿐만 아니라 그 기반이 되는 상속법 가치이념에도 다소 차이가 있지만 전체적으로 볼 때 현대 여러 국가의 상속법이 추구하는 법치정신은 일치하다. 중국 민법전 상속 편은 마땅히 현대 상속법의 가치 이념을 충분히 전개하고, 효과적인 사법해석과 비교법적인 고찰을 통한 성숙한 입법을 수용하여 상속편의 체계적이고 과학적인 입법을 실현하여야 한다. 본 연구는 중국 민법전의 상속 편을 중심으로 중국 상속제도의 전망에 대하여 논의하고 그 완전한 입법을 위하여 개선방안을 제시하고자 한다.

On May 28, 2020, the third session of the 13th National People's Congress of the people's Republic of China voted to adopt the civil code of the people's Republic of China, which will come into force on January 1, 2021. The code of succession of civil code is the regulation of the current law of succession and its judicial interpretation. According to the system observation of the civil code, the succession code not only needs to implement the basic principles of the succession system in the internal system, but also needs to coordinate the legal application disputes between the succession code and other parts of the civil code in the external system, such as the general principles of civil law, the property code and the contract code. However, it has a strong mark of legal compilation in the system, does not widely absorb and adopt the effective provisions in judicial practice in the content, and does not fully reflect the development trend of modern inheritance system in the 21st century in the concept of legislative value. The code of succession of Chinese civil code should fully show that "the right of inheritance of private property is protected by law; all heirs have equal right of inheritance; deal with heritage, We should respect the will of the heirs and the heirs, pay attention to the supporting function of the heritage, and protect the interests of the creditors of the heritage. We should absorb a lot of judicial interpretations and other legal norms that have been proved effective in practice, so as to realize the scientific nature and operability of legislation. This paper starts from the succession of Chinese civil code, and analyzes it, hoping to make a little contribution to the improvement of the legislation of Chinese succession system.
