Asymmetrical dispute resolution clauses are upheld in numerous jurisdictions based on the principle of party autonomy. However, party autonomy is not without limitations. This article aims to analyze the challenges of asymmetrical dispute resolution clauses especially regarding bargaining power, consideration, potestative conditions, and the right to fair trial. It also analyzes the different reactions and remedies in different jurisdictions.
