연쇄살인에 대한 논의는 오랜 역사를 지닌 주제임에도 불구하고, 근본적인 정신구조의 차원에서 그들을 이해해 보려는 노력은 그다지 주목을 받지 못하였다. 이는 연쇄살인의 가시적인 현상이 보여주는 잔혹함에 매료되어, 그러한 현상적인 차원의 거울로만 연쇄살인범을 비추어봄으로써 비난의 목소리만을 부추길 뿐, 그들에 대한 진정한 이해를 해보려는 자세를 가지지 못한 데에서 나타난 안타까운 모습이라고 할 수 있다. 그리고 이러한 사회적인 시선 못지않게, 연쇄살인범에 대한 현행 (형)법의 기본입장 또한 강한 응보주의적인 태도를 일관되게 고수하고 있다. 본고에서는 연쇄살인범을 단순히 사형을 받아 마땅한 괴물이기 이전에, 일반적인 다른 범죄자들과 다른 차원의 공격성을 지닌 인간으로 바라보고, 이러한 ‘실재적 공격성’에 대하여 논의하고자 한다. 그리고 이러한 실재적 공격성의 발현으로서의 ‘도착증적인 정신구조’에 대한 논의를 해봄으로써, 연쇄살인범이 ‘법을 대하는 적대적 태도’와 그들의 ‘연쇄성’에 대해 심도 있는 이해를 시도하고자 한다. 더 나아가 ‘도착증’이라는 렌즈를 통해 연쇄살인범을 바라보면, 그들은 비록 자신의 행위가 갖는 불법성을 인지적으로 인식할 수는 있지만, 법규범을 내면화하지 못하는 도착증적인 장애로 인해 일반인과는 다른 고유한 정신구조를 띄게 된다. 이러한 도착증적인 정신구조에 대한 형법적 고려로서 세 가지의 법적 문제를 제기해 보고자 한다. 먼저, 이러한 도착적인 정신 구조로 인해서, 연쇄살인범의 ‘책임능력’에 관한 문제가 제기될 수 있는데, 여기서는 특히 불법을 범하지 않을 ‘의사결정능력’에 흠이 있는 지 여부를 검토한다. 다음으로, ‘법률의 착오’ 문제를 제기하고자 한다. ‘도착증’에 대한 라캉의 해석을 보면, 연쇄살인범은 법규범의 존재 또는 그 효력에 대한 인지상의 부지가 문제되는 것이 아니라, 좀 더 근원적인 차원에서 법의 구조를 내면화하지 못함으로써 발생할 수 있는 ‘법률의 부지’ 또는 ‘효력의 착오’에 관한 문제가 등장할 수 있다. 마지막으로, 트라우마 이론을 통한 ‘양형상의 책임’에 관한 논의를 제안하고자 한다. 여기서는 연쇄살인범의 양형책임을 하는데 있어서, 현재 법원실무상 적극적으로 적용되고 있는 않는 ‘형법 제51조’의 고려사항으로서, ‘도착증적인 정신구조가 <형성>되는 과정에서 과연 연쇄살인범의 자기책임은 어느 정도로 존재 하는가’에 관한 논의가 필요하다.

Although the discussion of serial murder is a long-standing topic, efforts to understand them in terms of the underlying mental structure have not received much attention. It is fascinated by the brutality of the visible phenomena of serial murders, and it is sad to see that they only provoke the voice of blame by looking at the serial killers only with such a phenomenal mirror, and that they do not have the attitude to try to truly understand them. And as much as this social gaze and the public’s attention, the basic position of the current (criminal) law on serial killers also consistently adheres to a strong retributive attitude. In this article, we consider the serial killer as a human with a different level of aggression from other criminals in general, and discuss this ‘real aggression’ before being a monster deserved to simply be executed. In addition, by discussing the ‘perversion’s mental structure’ as the manifestation of this real aggression, I would like to try in-depth understanding of the serial killer’s ‘hostile attitude toward the law’ and their ‘seriality’. Furthermore, when looking at a serial killer through a lens of ‘perversion’, they can recognize the illegality of their actions cognitively, but because of a disorder called ‘perversion’ that does not internalize the laws and regulations, they has a unique mental structure different from that of the general public. I would like to raise three legal issues as a criminal consideration for this mental structure of perversion. First of all, because of this mental structure of perversion, the issue of ‘criminal responsibility’ of a serial killer may be raised, and here we especially examine whether there is a flaw in the “decision-making ability” that unwilling to commit illegality. Next, I would like to raise the question of ‘Mistake of Law’. Looking at Lacan’s interpretation of ‘perversion’, serial killers are not concerned with a matter of cognitive ‘ignorance of law’ - ignorance for the existence or effect of legal norms- , but at a more fundamental level, the question of ‘Ignorance of Law’ or ‘Mistake of effect’ may arise, which may arise from the failure to internalize the structure of the law. Finally, I would like to propose a discussion on ‘sentencing responsibility’ through trauma theory. Here, in regard to the sentencing responsibilities of serial killers, as a consideration of ‘Article 51’ of the Korean Criminal Code, which is not currently actively applied in court practice, It is necessary to discuss ‘How much self-responsibility of serial killers exists in the process of < formation > of the mental structure of perversion?’
