본 연구는 국선보조인제도에 참여한 위탁소년을 대상으로 국선보조인의 성실성, 태도, 신뢰도 및 만족도 등에 관한 인식을 분석하여 국선보조인제도가 소년보호주의 이념과 적법절차원칙을 보장하는 주요한 제도로서 운영되도록 실효성 있는 개선방안을 제시하는데 목적이 있다. 이를 위해 국선보조인 접견 경험이 있는 K시 소년원의 위탁소년 41명을 대상으로 조사연구를 실시하였다. 연구결과를 통해 비행소년의 특성을 고려한 국선보조인제도의 운영 지침 마련, 둘째, 소년들의 심리이해, 상담기법, 법률지식 강화를 위한 현장 교육 확대, 셋째, 국선보조인 전문화를 위한 제도적 장치 마련 등 다양한 개선방안을 제시하였다. 본 연구는 국선보조인 활동에 대한 소년들의 인식을 평가했다는 점에서 연구의 의의가 있다. 향후 전국적인 조사를 통해 사회인구학적 특성과 비행경력 등에 따른 국선보조인의 평가를 실시하여 소년보호사건에서 국선보조인 활동을 강화할 수 있는 방안을 모색해야 할 것이다.

The purpose of this study is to research perceptions of the Court-Appointed Assistant’s sincerity, attitude, reliability, satisfaction and to suggest how to improve the Court-Appointed Assistant System as a major system to guarantee the ideology of juvenile protectionism and juvenile justice. To this end, the data needed for this study was obtained by 41 consignment boys from K City juvenile reformatory, who had experience in interviewing Court-Appointed Assistants. The result are as follow. First, preparation operation guidelines for the Court-Appointed Assistant System considering the characteristics of the juvenile delinquents, Second, expanding on-the-job training for reinforcement psychological understanding, counseling techniques, and legal knowledge of the boys’, Third, suggesting various improvement method, providing an institutional strategy for the specialization of the Court-Appointed Assistant. This study is significant in that it assessed boys’ perceptions of the Court-Appointed Assistant activities. In the future, the nationwide survey should be seek for the Court-Appointed Assistant by sociodemographic features and delinquent career, and to find a way to reinforce the Court-Appointed Assistant in the juvenile protective disposition.
