기술의 비약적인 발전으로 새로운 유형의 비신체적인 성폭력이 등장함에 따라, 「성폭력범죄의 처벌 등에 관한 특례법」은 카메라 등을 이용하여 성적욕망 또는 수치심을 유발할 수 있는 사람의 신체를 그 의사에 반하여 촬영하는 행위를 처벌하고 있다. 특히 카메라등이용촬영죄는 여타 성범죄에 비하여 압도적인 증가율을 보이며 왜곡된 성문화와 함께 악순환하고 있다. 한편, 법원은 촬영물의 음란성 여부에 집중하고 있어 법익 침해가 명백함에도 피해자의 전신이 촬영된 경우·성적 부위가 부각되지 않은 경우·일상생활의 모습을 그대로 촬영한 경우에는 성적 욕망 또는 수치심이 유발되지 않는다고 판단하는 경향이 있다. 따라서 피해자의 ‘성적 자기결정권 및 함부로 촬영당하지 않을 자유’를 보장하기 위해서는 카메라등이용촬영죄를 비롯한 성범죄의 본질을 이해하고 이에 근거한 해석의 기준을 재정립하는 것이 필요하다. 이에 본고에서는 카메라등이용촬영죄의 입법목적과 보호법익에 대한 검토를 바탕으로 구성요건 해석의 방향을 확인하였다. 아울러 이를 바탕으로 구성요건 해석의 다양한 기준과 판례를 분석함으로써 지엽적인 현상에 매몰되는 것이 아닌 법익 침해적 행위에 초점을 맞춘 구체적인 해석기준을 모색하였다.

With the emergence of a new type of non-physical sexual violence in the rapid development of technology, the Special Act on Cases concerning the Punishment, etc. of Sexual Crimes prescribes punishment for an “illegal picture-taking a body part of a person against his or her will to can cause sexual desire or shame using a camera or other mechanical device with similar function”. In particular, the crime of illegal picture-taking has been an overwhelming increase in the number of crimes compared to other sex crimes and in a vicious circle with distorted sex culture. Meanwhile, the court tends to judge that sexual desire or shame is not induced when the victim’s whole body is filmed, the sexual part is not highlighted, or the life scene is taken as it is, despite the obvious violation of the law. Therefore, it is necessary to understand the essence of sex crimes, including illegal picture-taking, and to redefine the standard of interpretation based on them, in order to ensure the victim’s “sexual self-determination and freedom not to be photographed without permission.” In this study, the purpose of legislation and the benefit of the crime law in the illegal picture-taking crime were reviewed. Based on this, This study presented a direction of interpretation relative to components of criminal norm. In addition, by analyzing various criteria and a judicial precedents, specific interpretation criteria focused on infringement of the law was proposed rather than being buried in peripheral things.
