이 글은 피에르 르장드르의 법인식론을 통해 법과 이미지의 관계를 살펴보고, 법이 재현을 통해 보증하는 주체의 정체성과 그 물질적 조건의 토대에 대한 법정신 분석학적 이해를 시도한다. 르장드르에게 법은 거울이다. 법이라는 거울은 그 앞에 선 인간 존재에게 이미지를 비춰줌으로써 그를 사회 구조 내에서 상징적 교환이 가능한 주체로 사회화시키고, 타자와의 관계 속에서 주체가 출현하는 것을 보증하는 대타자의 위상을 차지한다. 이렇게 주체성의 제도적 차원을 정초하는 거울은 인과관계에서 결과에 해당하는 이미지의 존재를 보증함으로써 모든 재현에는 원인이 있을 수밖에 없다는 근거율로서 기능하는 것이다. 그 자체로서는 근거가 없는 원칙에 기초하고 있음에도 진리에 준거하고 있음을 증명할 수 있는 담론으로서 법은 이미지에 대한 정치적 애착을 통해 계보학적 정체성을 재현해줌으로써 주체의 재생산을 가능하게 하며 사회를 유지시킨다. 이러한 법인식론은 법이 의존하고 있는 이미지의 차원에 대한 성찰을 가능하게 한다. 신분증은 독립된 개인의 신원을 확인해주는 것이라기보다는 이미지에 대한 애착을 통해 국가에 종속된 채 자유를 누리는 국민의 신원을 보증해주는 것이다. 한편, 거울로서 법이 자신의 기능을 다하기 위해서는 등기의 공신력을 통해 삶의 물질적 기반이 되는 부동산 소유권을 보증할 필요가 있다.

This article tries to understand the relationship between Law and Image through the legal theory of Pierre Legendre. Also, this article applies his understanding to the legal psychoanalytic foundation of the subject’s identity and material conditions guaranteed by representations of Law. For Legendre, Law is Mirror. Law as Mirror reflects an image of whom stands before it, socializes him/her as the subject who can be symbolically exchanged within the social structure, and becomes the Other that guarantees the appearance of the subject within others. Mirror which establishes the institutional dimension of subjectivity functions as the Principle of Reason that every representation has its cause, by guaranteeing the existence of images as the results of causality. Although it is based on Principle that is not grounded in itself, Law as the discourse of reference to the Truth enables the reproduction of the subject and maintains society by representing the genealogical identity through political attachment to the Image. Such legal theory allows us to reflect on the imaginal dimension on which Law depends. The identification card is not to confirm the identity of an independent individual but to guarantee the identity of the nation who enjoys freedom while being subordinated to the state through attachment to the Image. And in order for Law to function as Mirror, it is necessary to guarantee ownership of the real estate, the material basis of life, through the indefeasibility of registration.
