근래 한국사회 다양한 영역에서 일어난 ‘미투’(ME TOO)운동은 종전에는 묵인되기 쉬웠던 성폭력을 수면위로 드러내는 데에 일조한다. 체육계에서도 예외가 아닌데, 근래 운동선수들에 대한 지도자의 폭력과 성폭력에 대한 폭로가 이어졌다. 이러한 폭로가 큰 충격을 주었던 이유는 어린 나이부터 선수들이 부모의 곁을 떠나 단체합숙생활을 하여, 지도자가 부모에게서 선수의 보호자 역할을 위임받는다는 현실에 있다. 선수는 지도자의 명에 복종한다. 오히려 지도자가 범죄의 가해자였다는 점은 심히 충격적이다. 선수로서의 경력과 진로를 좌우할 수 있는 지도자의 폭력에 대하여 어린 선수들이 취할 수 있는 대응은 극히 제한적이었을 것이기 때문이다. 체육계에서 발생하는 성폭력의 심각성은 이미 2007년 언론을 통하여 세상에 알려졌었다. 2019년 문화체육관광부는 축구, 야구, 농구, 배구, 골프 5대 스포츠를 대상으로 한<프로스포츠 성폭력 실태조사>를 실시하여 스포츠 성폭력의 실태를 파악하고 대응책으로 가해자 영구제명, 피해자 지원센터 설치 등을 제안하였다. 체육계 성폭력은 단체합숙생활 속에서 진로를 좌우하는 동일한 사람으로부터 장기간, 상습적으로 이루어지는 경우가 두드러진다. 때문에 일반 성폭력과는 다른 ‘체육계 성폭력’ 의 대응 방안이 필요하다. 본고에서는 체육계의 특수성을 고려하여, 체육계 성폭력을 개념 정의하고. 그 실태를 서술한 후 대응 방안을 제시하였다.

Nowadays so-called #MeToo movement has been spread through and sexual violence has been covered in Korean society by the announcement of a young skating athlete. Many sports athletes have ever experienced being sexually abused by their colleagues or leaders like as a coach. Some coaches seem to be offenders of sexual harassment and violence. Usually, a coach is entrusted with the role of guardian of an athlete from his or her parents. It is shocking that the coach is the perpetrator of the crime. The Korean government is trying to eradicate sexual violence in sports. In 2019, the Ministry of Culture, Sports and Tourism conducted a survey on the sexual violence in the professional sports of soccer, baseball, basketball, volleyball, and golf to identify the status of sexual violence in sports and propose countermeasures. The special investigation team of the National Human Rights Commission of Korea held the < 1st Sports Human Rights Camp > on July 17 and 18, 2019 for 73 ice skaters. If we think that sexual advance that the victim does not want means sexual violence, we can punish the offender as sexual violence offender. This article is aimed at defining sexual violence in sports and suggesting countermeasures against it. I think that sports sexual violence includes “unwanted sexual advance” in sports and suggest that all of the unwanted sexual advances have to be punished according to criminal law.
