본 연구는 최근 제정된 「제주특별자치도교육청 난치병 학생의 교육력 제고를 위한 지원 조례」의 입법과정과 쟁점을 분석하였다. 입법과정에 대한 분석 결과는 첫째, 교육조례 의제는 정치·사회적 배경과 정책 변화 및 주민의 조례 입법요구에 의한 조례 제정의 필요성이 핵심이었다. 둘째, 교육조례의 입법화는 입법 절차상 권한과 교육복지 확대에 대한 관점의 차이를 정리해 나가는 과정이었다. 셋째, 교육조례의 입법 확정 및 정책 결정과정에서는 교육위원회의 심사와 본회의의 의결 과정에서 교육당국의 입법 의지가 중요하였다. 넷째, 정책 결정 과정에서 관련 시행규칙을 제정하되, 조례에 따른 정책 사업들이 제대로 설계될 수 있도록 쟁점 사항들을 충분히 반영할 수 있도록 수요자들과의 협의와 의견 수렴이 중요하였다. 입법과정에 제기된 쟁점에 대한 분석 결과는 첫째, 조례 입법화는 지방선거에서 공약으로 제시된 정책사업을 추진하기 위한 근거로써, 학부모의 입법요구를 수용하여 결정되었다. 둘째, 조례안을 확정하는 과정에 도지사와 교육감의 권한 논란, 교육복지 확대에 대한 찬반 입장, 입법정책관실의 법적 근거, 특수교육법과의 관계 등에 대한 논란이 있었고 학부모와 의견 수렴 과정에서 지원방안들이 제기되었으며 시행규칙 제정 과정에서 실효성있는 지원구조를 체계화했다.

This study analyzed the legislative process and issues of the recently-sponsored Support Ordinance of Jeju Special Self-Governing Education Office for Enhancing Education of Students with Incurable Diseases. The results of the analysis of the legislative process were as follows. First, the agenda was based on the change of political and social background and policies, and the necessity of enactment by the legislative requirements of the residents. Second, the legislative was arranging the differences between the authority on the legislative and the perspective on expanding educational welfare. Third, in the process of deciding the legislation and policy decision, the will of the education authorities was important in the process of review by the Board of Education and the plenary session. Fourth, it was important to enact enforcement rules, but to consult and collect opinions with consumers who can fully reflect the issues in order to properly design policy projects. The results of the analysis of the issues raised in the legislative process were as follows. First, the ordinance was decided to accommodate the legislative demands of parents as a basis for promoting the policy projects proposed as pledges in local elections. Second, there was controversy about the governor's and superintendent's authority debate, the pros and cons of expanding educational welfare, the legal grounds of the Legislative Office, and the relationship with the special education law. In the process of enacting the Rules, effective support structures were systematized.
