현재 의료계는 진단과 연구를 위한 대규모의 자료 분석 및 처리, 경제적 지속 가능성, 세계 인구의 고령화 대비 등의 요인으로 인해 근거중심 의료와 정밀 의료를 요구받고 있다. 이를 위해 끊임없이 생성되는 자료를 분석하여 의료인의 의사결정을 지원하는 기술이 필수이다. 따라서 미래 의료에서 인공지능을 기반으로 한 “의료지원 로봇”이 활성화될 것으로 예상된다. 그런데 인간의 판단만이 아니라 인공지능 시스템의 판단도 책임의 문제를 불러 올 수 있다. 이러한 문제에 대한 대비 없이는 그 기술을 적절히 사용하기 어려울 것이라 예상된다. 본 논문은 인공지능기술을 가장 먼저 실제적으로 적용하고 있는 자율주행자동차 발전 5단계에 비추어 인공지능영상판독 발전 5단계를 설정하여 논의를 진행한다. 먼저 본 논문은 자율주행차의 기술 발전 단계를 5단계로 나누고 각 단계별 책임 문제를 다룬다. 이후 미래 의료에 적용될 인공지능 기술 중 가장 첨단에 있는 인공지능영상판독 기술을 5단계로 나누고 책임문제를 간략히 고찰하고 있다. 특히 완전자율영상판독 단계에서 그 책임을 시스템이 지느냐 공급자가 지느냐에 관해 논쟁적인 두 입장을 고찰하여 보았다. 필자들은 자율주행차나 자율영상의료판독은 인간의 의사결정과 유사한 의사결정을 통해 가능하며 이 현상적 자율 행위자들은 유사 행위자로 온전한 법적 책임을 질 수는 없다고 보았다. 따라서 본 논문은 미래의료에서도 책임은 인간 행위자에게 물어질 수 있는데 다만 인공지능 공급자로서 소프트웨어 회사와 제공받은 회사, 의료에 사용하는 의료인과 그 결정을 받아들이는 환자들이 지게 되는 책임의 양과 질이 매우 달라질 것을 전망하고 있다.
The medical world today is urged to realize the evidence-based medicine and the precision medicine by some current trends like a large-scale data analysis and processing, economic sustainability and world population aging. To achieve this, a technology of analyzing endless data and supporting decision-making of medical personnel is indispensable. Thus, AI-based "medical robot" is expected to be actively deployed in future medical treatment. However, apart from human decision making, AI systems cannot be free from the problem of responsibility. If no adequate solution or measure for this issue is provided, AI technology will not be effectively applied to medical treatment. This paper uses the 5-stage scheme of technical advance in autonomous car, which is the first field to apply AI technology practically, to set 5 stages for AI-based image reading. As an initial step, this paper identifies 5 stages of technical advance in autonomous car and addresses the issue of responsibility for each stage. Then, the 5-stage scheme is applied to AI-based image reading technology which is the most advanced area in future medical treatment, and the responsibility issue is briefly considered. As for which party is responsible between AI system and provider especially at the stage of fully autonomous image reading, two conflicting arguments are analyzed. As we think that both the autonomous car driving and the autonomous image reading cannot be performed without decision-making that is similar to human's, it is concluded that those phenomenological autonomous agents are only a pseudo-agent thus cannot have full legal liability. As a result, future medical treatment will attribute responsibility to human agents. However, the amount and degree of responsibility will be very differently allocated among a software company as a provider of AI, a company buying AI, personnel using AI and a patient accepting the decision-making of AI.
