국가는 국민의 생명과 재산을 지키고 인간으로서 누려야할 권리를 보호하기 위해 합의에 의해 형성된 하나의 합의체이다. 이러한 합의를 통해 만들어진 국가는 국가에 소속된 구성원들을 보호하고 그 외의 이방인들을 배격하면서 국가의 틀을 형성해 왔다. 즉, 동일한 인종, 동일한 문화, 동일한 언어를 바탕으로 하나의 구성체를 이루어왔다는 것이다. 결국 이러한 민족주의는 다른 것을, 차이나는 것을 인정하지 못했고, 단지 차별의 대상으로서 또는 혐오의 대상으로서 여겨왔을 뿐이다. 그러나 시대의 흐름을 통해 세계화, 개방화의 물결 속에서 1990년대 다양한 인종과 민족들이 직업을 얻기 위해, 생계를 유지하기 위해 국내로 유입되었다. 하지만 그들은 다른 인종, 다른 언어에 의해 어려움을 겪어야 했고, 이러한 어려움은 그들을 인종차별, 멸시, 모욕, 혐오의 대상으로 만들어 버렸다. 대한민국영토 내에서 삶을 영위해 가는 모든 구성원들은 헌법에 따라 기본권적 권리를 부여받는다. 이러한 기본권적 권리는 그 본질적인 내용에 있어서는 법률에 의해서도 제한할 수 없도록 명문화하고 있다. 하지만 국내체류 외국인들은 사실상 헌법이 규정하고 있는 기본권적 권리들을 인정받지 못하고 있는 것이 사실이다. 기본권이라고 하는 것은 그 대상이 내국인이건 외국인이건 상관없이 누릴 수 있는 천부인권적 권리이기 때문이다. 하지만 국내체류 외국인들은 이러한 어려움을 극복하지 못하고 범죄를 범하게 된다. 이러한 국내체류 외국인들의 범죄발생을 억제하기 위해서는 범죄발생후의 직접적 대처도 중요한 일이지만 그것보다 더 중요한 일은 범죄가 발생하지 않도록 사전에 예방하는 일이라고 할 수 있다. 따라서 범죄발생의 예방을 위해 경찰의 역할과 기능이 중요하게 작용하게 된다. 경찰은 수사권을 가지고 국가공권력을 행사하는 기관이지만 국민의 생명과 신체 및 재산을 보호하는 것을 가장 중요한 임무로 인식하는 기관이기 때문에 경찰에 의한 외국인 범죄를 예방할 수 있는 방안이 마련되어야 한다.

The nation is a consensus formed by an agreement to protect lives, body and property of people and to secure basic rights as human beings. A nation created by such an agreement has formed a framework by protecting its people and excluding other foreign nationals. A nation has been built on the same ethnicity, the same culture, and the same language. After all, this nationalism did not admit the others and they were only regarded as objects of discrimination or hatred. However, in the midst of globalization and openness, various races and nationalities have more entered South Korea to get jobs and to earn a living since the 1990s. But they suffer difficulties of racism, contempt, insult and disgust because of being different races and using languages. All members of the South Korean territory are given basic rights by the constitutional law. These basic rights are stipulated in essential matters that they cannot be limited by such law. However, it is true that foreign residents in South Korea do not fully enjoy the basic rights that the constitution law stipulates. The basic right is fundamental that everyone enjoys regardless of whether the one is a Korean or a foreigner. However, it is not easy to foreigners living in South Korea to overcome these difficulties and they are highly probable to commit crimes. It is important to directly response right after crime occurrence, but it is more important to prevent crimes in advance in order to deter the creation of crimes. Therefore, the role and function of the police is important to prevent crime. Because the police executes governmental authority with investigative rights, it should come up with measures to prevent crimes of foreigners to protect people’s lives, bodies and property as the most important task.
