대통령제는 200여 년 이상 오랜 기간 동안 그 기본 골간을 유지한 채 미국 헌정의 기본 구조로 이어져 내려오고 있는 정부형태이다. 의원내각제와 함께 정부형태의 전범으로서 여러 신생국에게 영향을 주고 있음은 물론이다. 변동하는 국내·외 정치 상황에 따라 개별 대통령 권력의 강도에 차이는 있었지만, 국가 원수와 행정부 수반으로서 대통령의 헌법상 지위에는 큰 변화가 없었다. 그러나 약 10여 년 전, 헌법학자 애커먼(Bruce Ackerman)이 분석·진단하였던 미국 대통령제와 공화제의 위기는 마치 예언처럼 실현되고 있다. 그 변질의 본질은 대통령 권력이 지나치게 비대해졌다는 것이다. 우리 정치에서 늘상 비판되어 오던 소위 ‘제왕적 대통령제’는 미국에서도 심각한 문제로 언급되고 있다. 외형적으로 헌법이 개정되지도 않았고 민주주의의 모습 또한 근본적으로 바뀌지 않았음에도 이러한 변질의 현상이 나타나고 있는 것은, 미국 대통령제 그 자체가 절대선이 아니라는 점을 보여준다. 헌법의 권력분립원리는 권력욕에 사로잡힌 대통령이 등장할 때 언제든 손상될 수 있다는 점에서 여실히 드러난다. 미국인들은 민주정치의 오랜 경험을 통해 애써 헌법정치의 이상을 수호하려 노력하였지만, 그 또한 불변의 전통은 될 수 없다. 결국 이러한 권력의 탈주를 제어할 장치가 필요하며, 그것은 민주정치를 바로잡는 헌법제도적 차원에서 이루어져야 한다. 애커먼은 대통령제의 변질 원인으로 크게 세 가지를 열거한다. 첫째, 극단주의자가 득세하도록 조장하는 미국 선거제도와 정당제도이다. 둘째, 군이 정치화되어 대통령 권력을 지지하고 있다는 점이다. 셋째, 행정부에 법률 전문가가 다수 진출하여 헌법논리를 정치적 정당화의 도구로 삼는 경향이 팽배해지고 있는 현상이다. 이러한 문제를 바로잡을 수 있는 방안으로 애커먼은 적극적 시민 참여를 제도화 함으로써 민주정치를 계몽하여야 한다는 점을 제시한다. 또한 군개혁과 대통령의 비상적 권한을 제한하기 위하여 행정 영역에서 법치주의를 확립하게 하는 방법을 제시한다. 마지막으로 행정부 내에 최고행정재판소를 설립함으로써 사법적으로 통제할 수 있는 제도를 제안한다.

Presidentialism is a governmental system that has governed the American constitutional politics for a long time over 200 years without a considerable change. It has been a classic model of a political system, like parliamentary system of the United Kingdom, that have diverse influence on many new independent countries. However, about ten years ago, a constitutional scholar Bruce Ackerman analyzed and indicated the possible problems of American presidentialism. And his prediction proved persuasive. The essence of his idea is that American presidentialism under the Constitution can produce Imperial Presidency: a president with too much power. Even though the fundamental structure of the U.S. Constitution has not been amended much, apparently, and the basic framework of democratic politics of the U.S. has not been changed, we confront the decline of the American presidency that Ackerman predicted. This is because the U.S. Constitution is not the absolute good or the perfect document. Americans have tried to build sound democracy to respect constitutionalism. But if not systematized to control the problems, presidentialism can be degenerated. Ackerman presents three causes of the decline: extremist presidency, politicized military, and executive constitutionalism. Ackerman’s cure for them starts from making politics enlightened through adopting deliberation day, internet news voucher, and popular sovereignty initiative. Furthermore, he emphasizes to restore the rule of law in the field of administration. In addition, he suggests to create a supreme administrative court like the French Conseil d'Etat.
