박정희 정권은 국가 정체성 구축과 정권의 정당성 확보를 위해 여하한 행위들을 ‘사회악’으로 호명하며 반공과 내핍의 이데올로기를 설파했다. 본 연구에서는 재정적 제약에도 불구하고 어떻게 그와 같이 상시적인 ‘사회악’ 척결 기획이 지속될 수 있었는지를 설명하고자 했다. 첫째, ‘사회악’에 대한 대대적인 단속과 입건은 사건 증대로 인한 형사절차의 지연과 인력난을 초래할 수밖에 없었다. 이에 형사정책의 ‘근대화’, ‘효율화’를 명분으로 수사 및 재판 절차에 대한 통제와 신속처리를 강화했고, 이는 형사절차상 기본권 보호 원칙의 후퇴와 사법부의 무력화를 의미했다. 둘째, 검거 확대와 형량 강화는 교정시설의 인구 과밀과 재정 부담을 가져왔다. 이에 구금 시설의 필요 재정은 자급하도록 하고 세입 확보를 위한 노역 활용을 촉진했다. 또한 ‘반국가사범’을 제외하고는 가석방을 확대하여 행형 비용의 부담을 최소화 하려는 선별적인 출구전략을 동원했다. 셋째, 교정시설로부터 탈구금화 된 이들은 개척단, 국토건설단, 갱생건설단 등을 통해 국토건설사업의 필요 노동력으로 활용되었으며 이를 확보하기 위한 ‘사회악’단속 역시 강화되었다. 형사사법의 재정 부담은 물론 경제개발 과정에서의 투입 비용을 최소화하기 위한 이와 같은 전략은 치안 기관의 협업과 이들의 재량권 남용을 통해 가능했다.

The ‘folk devil’ interpellation of Park Chung-hee regime served as an anti-communist ideology aimed at austerity for building of the nation-state and the legitimacy of the regime. This paper investigates how punitive policies were sustained and the role the criminal justice system played in the process. First, increases in the number of incidents led to large-scale enforcements that resulted in criminal proceeding delays. Warrant issuances and sentencing guidelines were introduced to facilitate ‘streamlining’ of case processing in the name of ‘modernization’ and criminal policy efficiency. This resulted in the abolition of the principle of protecting fundamental rights in criminal procedure and with limits on judicial independence. Second, the overall expansion of sentencing and incarcerations of ‘Folk Devils’ brought about overcrowding and financial burden of correctional facilities. The government was thus pushed to use forced labor as a part of its penal system, which set out to finance the operation of facilities through self-sufficient means and initiated a selective exit strategy that gave lenient paroles to the convicted but with the exclusion of these political prisoners. Third, those who had been paroled or not been sent to a correctional facilities served as labor force for the Land Development Policy such as the land construction unit and the pioneer group. This strategy was sustained systemic abuse of power during investigation, prosecution and penal dispositions.
