2011년 개정 민법은 법원에 성년후견인 선임에 대한 재량을 부여함으로써 가족 이외의 제3자가 통상적으로 성년후견인이 될 수 있는 길을 열어주었다. 새로운 성년후견 제도가 목적을 달성하기 위해서는 후견인 양성, 후견인에 대한 지원과 감독 등을 통한 국가의 개입이 필요하다. 이를 위한 관련 법제 정비를 위한 기초로서 프랑스의 전문 성년후견인인 `성년보호사법수임인`(이하 `사법수임인`) 제도에 대한 비교법적 고찰을 시도하였다. 프랑스가 기존에 존재하던 여러 종류의 성년보호 기관들을 통합하여 2009년부터 시행하고 있는 사법수임인 제도의 특징은 다음과 같다. 첫째, 성년보호 활동을 직업적 후견인인 사법수임인이 전담하는 대신, 상당한 수준의 교육을 거칠 것을 요구하고 지역별 성년보호 수요를 고려하여 자격을 부여하는 등 사법수임인의 자격을 국가가 엄격히 관리한다. 둘째, 사법수임인의 보수와 그 중에서 피보호인이 부담하는 부분이 법정되어 있고, 국가 등이 피보호인 부담 부분을 제외한 나머지를 지원하도록 법에 명시되어 있다. 그 덕분에 사법수임인 제도는 저소득층에 대한 사회복지 서비스로서의 역할을 확실히 수행하고 있다. 셋째, 사법수임인에 대하여는 그 자격 부여 및 관리의 차원에서, 개별 성년보호 사건에서의 활동에 대한 감시의 차원에서 2중의 감독이 이루어지고 있다. 프랑스 성년후견인 제도의 장단점을 분석하여 우리나라의 제3자 후견인 제도의 틀을 세우는데 활용할 필요가 있다.

The year 2009 saw a reform of the French adult guardian system that is the creation of the `mandataires judiciaires a la protection des majeurs`(MJPM). MJPMs replaced various types of professional adult guardians which existed in the old system, and are now the only professionals who can be assigned by the court to perform the tasks of adults protection provided by the French Civil Code. The MJPM system can be summed up as follows: As MJPMs are the only one who can act as professional guardians, only those who obtained a certificate by completing required training courses and are licenced by the government and registered in the government controled list can become MJPMs; Adults under protection pay some or all of the remuneration for their MJPMs and the rest is supported by the public funds, the tasks of MJPMs thus becoming a social welfare service especially for adults with low income; Supervision of MJPMs is done first by the court in terms of their specific performances, and again by the government in terms of their qualification. Further analysis on the merits and demerits of the French guardian system will be helpful in designing our own system of professional adult guardians.
