The Isolation among the Isolated: Raising the issue of the `Non-protected` North Korean Refugees

As of 2016, the number of North Korean refugees who have entered into South Korea has exceeded 30,000. It has become a center of the North Korea-related policies that ensure North Korean refugees settle down as South Korean citizens and live a worthwhile life in South Korea. Although many of the North Korean refugees are getting the protection and support from the South Korean government by the “North Korean Refugees Protection and Settlement Support Act", there is a large number of `non-protected` North Korean refugees neglected from the resettlement policy. This paper aims to introduce the problem of `non-protected` North Korean refugees and analyze the related provisions in the North Korean Refugees Protection Act. This article examines the definition of `protection` under the Act and discusses the criteria for protection decisions. It will introduce the procedure of `non-protection` decision-making and raise the problems behind the non-protection decision and the difficulties that `non-protected` North Korean refugees are faced with settlement to Korean society. In the last 10 years, the South Korean government has amended the Act several times; the problem has not yet been solved fundamentally. Efforts should be made to look back at the `non-protected` North Korean refugees, cure the provisions in the Act and Enforcement decree, and establish the appropriate remedy in order to achieve complete social integration. It is necessary to make a change in current blind spots of the Act as soon as possible to prevent the `non-protected` North Korean refugees from the isolation.
