본고는 정치체제로서 자유민주정치체제와 경제체제로서 자본주의 자유시장경제체제 두 체제를 고찰한다. 고찰 과정에서 세 가지 질문을 제기하는바 이는 첫째 자유 민주정치체제와 자본주의 자유시장경제체제란 무엇인가? 둘째 우리나라 헌법이 과 연 자유민주정치체제와 자본주의 자유시장경제체제를 얼마나 잘 구현하고 있는가? 셋째 자유민주정치체제와 자본주의 자유시장경제체제의 양립이 가능한가? 등이다. 본고가 논증하는 바는 첫째 자유민주정치체제에 대해서는 국민 모두가 나름 잘 알 고 있으나 자본주의 자유시장경제체제에 대해서는 전문가들조차도 제대로 인지하고 있지 못하며, 둘째 우리 현행 헌법은 자유민주정치체제는 상당 수준까지 구현하고 있으나 자본주의 자유시장경제체제와 관련하여서는 매우 미비한 수준이며, 셋째 자 유민주정치체제와 자본주의 자유시장경제체제는 기본적으로 양립이 불가능하다는 점이다. 오늘날 우리 사회의 수많은 문제가 이들 세 요인으로 인해 야기되고 있음을 밝히는 것과 더불어 본고는 정치적 의사결정 과정과 시장적 의사결정 과정이라는 두 과정의 본질과 차이, 정부의 정책이 각종 경제문제를 해결하지 못하는 이유와 정 부 정책에 대해 국민이 항시 불만을 갖는 이유, 헌법의 경제조항들이 경제민주화 양 극화 재벌 등의 이슈를 빌미로 개악될 가능성 등에 대해 문제의 제기와 이에 따른 답을 제시한다.

The paper deals with two systems: democracy as political system and market economy as economic system. In discussing two systems three questions are raised: firstly, what are democracy and market economy? secondly, how well does the Korean Constitution incorporate the spirit of democracy and market economy? thirdly, are democracy and market economy compatible each other? Answers provided to the questions raised above are: first, while general public in Korea understand well democracy, even scholars and experts in Korea are very poor in understanding the nature of market economy. second, the Korean Constitution incorporates quite well the spirit of democracy but nevertheless the spirit of capitalistic free market economy is poorly incorporated. to put it simply so many anti-capitalistic regulations are found in the Korean Constitution. third, the paper explains why democracy and market economy are basically not compatible. So many social and economic problems facing Korea have something to do with above three questions and answers. Furthermore the paper deals with more questions such as: why government cannot solve so many economic problems?, why general public are not satisfied with government policies?, and how much improvement one expects in revising economic articles of Constitution?
