의료기술이 발전하여 다양한 의료서비스를 제공하는 것이 가능해지고, 인간의 누구나 예뻐지고 싶은 심리를 충족하기 위한 수단으로 의학이 이용되면서 전통적인 의료행위의 개념에서 변화한 의료행위가 등장하고 있다. 대표적인 것이 미용성형수술이다. 미용성형수술이 보편화되면서 수술 부작용 등으로 인한 법적 분쟁도 다양해짐에 따라 관련 분쟁을 사전에 예방하거나 해결하기 위한 법리의 정립이 요구되는 시점에서 미용성형수술에서의 과실 판단 기준을 설시한 대법원2013.6.13. 선고 2012다94865 판결을 주목할 필요가 있다. 대상판결은 의사가 시술하고자 하는 미용성형수술이 의뢰인이 원하는 구체적 결과의 일부만을 구현할 수 있는 경우 의사에게 요구되는 주의의무와 설명의무의 정도에 대해 설시하였다. 의사는 시술하고자하는 미용성형수술이 의뢰인이 원하는 구체적 결과를 모두 구현할 수 있는 것이 아니고 그 일부만을 구현할 수 있다면 그와 같은 사실을 상세히 설명하여 의뢰인으로 하여금 그 성형수술을 시술받을 것인지를 선택할 수 있도록 할 의무가 있다고 하여 일반적인 의료행위보다 엄격한 수준의 설명의무를 인정하였다. 본 논문은 미용성형수술의 의료행위로서의 성질, 특수성 및 법적성질에 대해 고찰하여 미용성형수술에서 의사에게 인정되는 주의의무와 설명의무의 기준에 대해 논의한다. 이를 토대로 대상판결은 의료침습에 대한 정당화요소가 결여된 경우에 다른 정당화 요소인 설명의무를 보다 높은 수준으로 요구함으로써 책임귀속의 정당성과 결과적 타당성을 추구한 것으로 평가한다.

As various medical services can be provided through progressive of medical technology and medical treatments are being used to fulfill desire to be more beautiful, new kinds of medical treatments represented by cosmetic surgery services appear which are distinguish from traditional form of medical treatment. Ever since cosmetic surgery services became common, disputes related to side effects of cosmetic surgery are increasing. Therefore, establishment of legal criteria is needed to prevent dispute in advance or to settle conflict effectively. Thus, there is need to focus on Supreme Court Decision 2012Da94865 decided June 13, 2012 as the decision rendered standards of judging malpractice in cosmetic surgery. The decision suggested levels of duty of care and liability for explanation that are required to doctors, The decision rendered that when doctors can accomplish only a part of desired outcome suggested by patients not the whole of it, then doctors should explain that facts in detail, so that patients could determine whether they have cosmetic surgery or not. According to the decision, more stringent level of duty of explanation is required to cosmetic surgery services than traditional medical practice. This paper is aimed at considering duty of care and liability of explanation in cosmetic surgery services taking into account distinct characteristics and legal nature of cosmetic surgery services, and analyzing the decision based on previous discussions.
