디자인이 주목받고 있는 시대의 흐름에 따라 디자인이 산업에서 차지하는 중요성이 날로 커지고 있다. 창작자의 독점배타적 권리를 위해서는 디자인보호법상의 디자인으로 등록되어 보호받아야 한다. 디자인보호법상의 디자인은 물품성, 형태성, 시각성, 심미성의 요건을 갖추어야 한다. 디자인의 성립요건으로서 첫 번째 물품성은 독립성이 있는 구체적인 유체동산을 의미한다. 디자인은 물품을 떠나서는 존재하지 않는다. 다만, 최근에는 디자인의 물품성 요건을 완화하여 글자체디자인, 화상디자인, 부분디자인 제도를 반영하였다. 그러나 아직도 보호대상이 되는 물품의 범위와 물품의 동일성 판단에 대한 쟁점을 가지고 있다. 두 번째 형상·모양·색채 또는 이들을 결합한 것을 의미하는 형태성 요건이 있다. 형태성은 디자인 외관의 구성요소라고 볼 수 있으며, 형상만의 디자인과 동적디자인 등에 관련된 쟁점이 있다. 세번째, 시각성은 육안으로 식별할 수 있고, 외부에서 파악할 수 있는 것이다. 외부에서 인식할 수 없고 너무 작은 디자인은 어떻게 취급할지가 쟁점이다. 네 번째, 디자인의 성립요건으로서 심미성이 있다. 심미성은 디자인 성립의 중요한 요건이라고 할 수 있다. 그러나 미감은 주관적인 요소이므로 심미성 판단기준에 관해 쟁점이 있다. 이러한 디자인 성립요건들에서 제기되는 쟁점들과 판례 동향을 살펴 향후디자인보호법 개정시 도움이 되길 기대한다.

The importance of design is growing bigger and bigger in industry in according to the current design trends. Registered design is protected by the Design Protection Act. Design of Design Protection Act must have legal requirement such as an article of manufacture, configuration of article on design law, visibility, aesthetic aspect. Frist of all, an article of manufacture of design requirement means the specific tangible movables and an article of independent manufacture. Design can’t exclude an article of manufacture. Design Protection Act recently accepted the partial design, computer generated graphic designs, typeface designs. However, Design Protection Act is still becoming a key issue for the scope of the object protection and a judgment of similarity the article of manufacture. In the second requirement, the configuration of article on design law means the shape, pattern or color or any combination thereof in an article. The configuration of article on design law is the element of exterior design. It is at issue related the motion design and types of design utilization. Third requirement, the visibility should be able to see with the naked eye and understand the outside. The visibility issue is about the smallest design and the externally irrecognizable design. And finally, the aesthetic aspect is the important requirement of design establishment. The standard of judgment of aesthetic aspect is the subjective element, so it is difficult to decide. This article examined the issues and case trends on requirement of Design Protection Act. I hope this article is of some help to Design Protection Act revision going forward.
