지난 2012년 국제인터넷주소관리기구(Internet Corporation for Assigned Names and Numbers(``ICANN``))는 신규 일반최상위도메인 프로그램을 도입하였고 2012년 제1차 신청기간 동안 1,930건의 신청서가 접수되었다. 이에 따라 ``.com,`` ``.net,`` ``.org``와 같은 기존의 일반최상위도메인뿐만 아니라 사실상 모든 단어가 최상위도메인으로 사용될 수 있게 되었고 인터넷 상에 엄청난 수의 새로운 주소지가 생겨날 것으로 예상된다. ICANN은 신규 일반최상위도메인이름에 적용되는 권리보호장치(Rights Protection Mechanisms(``RPMs``))로서 국제적인 상표중앙저장소로서 상표 클리어링하우스(Trademark Clearinghouse(``TMCH``))를 도입하였고 상표 클리어링하우스는 신규 일반최상위도메인의 레지스트리 운영자가 최소한의 권리보호장치로서 우선등록 서비스(Sunrise service) 및 상표 클레임 서비스(Trademark claim service)를 제공하도록 강제한다. 또한 레지스트리 운영자는 자체적으로 고안한 권리보호장치를 추가적으로 시행할 것이 요구된다. 이러한 상표권자를 위한 권리보호장치는 남용적 도메인이름 등록 및 사용으로부터 상표권자를 보호할 수 있는 장치일 수 있으나 동시에 시스템 자체의 한계와 문제점을 내포하고 있으며 레지스트리 운영자에 의한 자체적인 권리보호장치는 정당한 권리를 가진 상표권자의 이익을 희생시키고 막대한 자본력을 가진 일부 거대기업들이 자본력을 바탕으로 다수의 신규 일반최상위도메인과 도메인이름의 등록 및 사용을 독식하고 통제하는 수단으로 이용될 가능성이 높다. 본 논문은 신규 일반최상위도메인을 위한 권리보호장치 가운데 상표 클리어링하우스의 권리보호장치와 레지스트리 운영자에 의한 자체적인 권리보호장치의 형태와 운영상의 문제점을 살펴보고자 한다.
In 2012, Internet Corporation for Assigned Names and Numbers(``ICANN``) approved the New gTLD program which dramatically changes the Internet domain naming system. The New gTLD Program allows for an increased number of generic top-level domains in any language. The application period for New gTLDs began on January 12, 2015 and a total of 1,930 applications were received during the application period. As of November 27, 2015, 803 new gTLDs are becoming available and over 1,300 new gTLDs are expected to be available in a couple of years. With the introduction of the New gTLD program, ICANN requires for a registry operator to provide the mandatory Rights Protection Mechanisms(``RPMs``) to prevent cybersquatting. the registry operator is required to offer TMCH sunrise service and trademark claims service. the registry operator is also requested to develop its own rights protection mechanisms to protect trademark owners from abusive registration and use of domain names. Currently, some registry operators have created their own RPMs and actively been implementing RPMs. In particular, Donuts Inc., which has applied for about 300 domains provides the Domains Protected Marks List(``DPML``) which offers rights owners the opportunity to block their marks and/or names including their marks, in all the Donuts gTLDs for a single fee. RPMs established by TMCH might be less effective because the trademark claims service is merely a notification service to trademark owners and registrants and it would be practically difficult and financially burdensome for trademark owner to check the Sunrise period of every New gTLD and register the domain name. RPMs offered by Donuts Inc. and other registries might be effective and attractive devices to protect trademark owners. However, it should be also considered that RPMs offered by registry operators violate rights of other trademark owners and domain name registrants. Furthermore, RPMs might hinder the promotion of diversity and competition, and the expansion of consumer choice.
