뉴질랜드는 사고로 인신 손해를 입은 사람에 대하여 기존의 불법행위제도에 기한 손해배상제도가 아닌, 매우 독특한 제도를 발전시켜오고 있다. 1967년 Woodhouse의 보고서를 기초로 1972년 사고보상법이 제정되면서, 인신 손해를 입은 자는 원인여하를 불문하고 국가(ACC)로부터 치료와 재활비용, 일정액의 소득 보전을 받을 수 있게 되었다. 전통적인 불법행위제도와는 달리, 피해자는 가해자의 과실과 손해와의 인과관계를 증명하지 않아도 되며, 가해자 개인에 대한 손해배상청구소송을 진행할 필요가 없다. 이것을 ``무과실 사고보상제도``라 부른다. 지금부터 무려 43년 전에 사고로 인신손해를 입은 자에 대한 신속하고 적절한 보상이 가해자 개인의 책임이 아니라 ``공동체의 책임``으로 인식하고, 이를 법률제도로 확립하였다는 것은 매우 흥미로운 연구주제이다. 뉴질랜드의 사고보상법이 어떤 경과를 거쳐 오늘에 이르고 있으며, 그동안의 성과에 대한 평가를 살펴본다면, 우리나라의 경우에도 장기적으로 인신손해를 입은 피해자에 대한 손해보상제도의 개선에 유익한 시사점을 얻을 수 있을 것이다. 이런 목적에 가장 부합되는 것으로 뉴질랜드 사고보상법의 40년 역사를 잘 정리한 Stephen Todd 교수**의 최근 논문을 번역하여 소개하였다. Todd교수에 의하면, 뉴질랜드는 국가(기구 Accident Compensation Corporation)을 통하여 인신손해 무과실보상에 대한 효율성을 확보한 것은 물론, 피해자에 대한 공정하고 신속한 구제수단을 제공하고 있어, 불법행위제도의 대안으로서 지금까지는 매우 성공적인 제도라고 평가하였다.
New Zealand has an unique compensation scheme, so called ``No-fault scheme``, for the injured people by accident including motor accident. 40 years ago, the New Zealand legislated ``Accident Compensation Act(ACA)`` by operated ACC(Accident Compensation Corporation) for accomplishment the responsibility of society for the injured. I have a very keen interest in Accident Compensation Act of New Zealand. After making a broad evaluation of its success, I think, Korea Government can consider the introduction of ``No-fault scheme`` into Korean legal system for providing fair compensation quickly and efficiently to deserving victims at an affordable cost. In this paper, I would like to introduce Accident Compensation Act of New Zealand by giving an translation of the article which was written by Professor Stephen Todd. Stephen Todd had an opinion that New Zealand`s Accident Compensation scheme has been operated reasonably well since its introduction in 1972. The compensation is fairy generous and is available with the minimum of formality. So far the most part available resources are used to meet the needs of qualifying. Even though the ACC is not perfect, but by comparison with the tort system it has been and continues to be a distinct success.
