오늘날 세계 각 국은 나날이 치열해지는 국가간 무한경쟁의 시대에 대응하여 국력을 신장시키기 위해서는 경제문제가 가장 중요하다는 인식을 갖게 되었다. 또 우리나라 경제규모가 커지고 핵심기술의 보유가 늘어나면서 이들 산업기술과 기술정보는 국가 경쟁력에 있어 매우 중요한 역할을 하고 있다. 이 연구는 우리나라 중소기업의 산업기술 보호역량강화방안을 도출하려는데 목적을 두고 있다. 우리나라의 경우, 산업기술보호에 관심을 가지게 된 것이 오래되지 않았으나 그 동안 정부와 기업의 꾸준한 노력으로 산업기술보호체계가 잘 구축되었고 산업기술 보호활동도 괄목할 수준으로 향상되었다. 그러나 우리 기업 전체의 대다수를 차지하는 중소기업의 경우 대기업에 비하여 산업기술 보호역량이 여전히 미흡하고 특히 부산과 같은 지방 중소기업들은 관리능력 부족으로 산업기술 보호체계가 매우 취약한 것으로 알려져 있다. 우리나라의 경우, 중소기업들은 대체로 산업보안의 중요성에 관한 인식이 낮고 자발적인 산업기술 보호 노력이 미흡한 반면 검찰, 경찰 및 국가정보원과 같은 국가정보기관이 산업기술 보호에서 주도적인 역할을 하고 있다. 따라서 기업의 독자적인 대응은 어려운 상황이므로 경찰과의 연계에 초점을 맞추어 전개해 나가고자 한다. 이 연구를 통하여 국내 중소기업의 산업기술보호 실태와 문제점을 점검하고 다음과 같은 대응방안을 제언한다. 첫째, 1차 피해에 이은 2차, 3차 피해를 막기 위한 매뉴얼 개발이 필요하다. 둘째, 산업스파이 범죄를 사전 예방할 수 있는 시스템 구축이 요구되고 셋째, 핵심기술유출에 대한 신속한 대응을 위한 통합센터구축이 필요하다. 넷째, 산업스파이 범죄 관련 경찰 전담수사대를 확대 시행하여야 한다. 다섯째, 관련 범죄자에 대한 강력한 처벌 및 수사과정에서의 2차 기밀유출이 되도록 신중한 절차가 요구된다. 이러한 조치들은 비용을 수반하게 되므로 기업의 경영과 산업기술 보호여건, 제반 조치에 수반되는 비용과 편익 등을 검토하고 그 중요성 등을 종합적으로 평가하여 우선순위를 정하고 순차적으로 추진해나가는 것이 필요하다.

Nowadays, the world has come to realize that a strong economy is the most important factor towards overcoming the overheated international competition and increasing national strength. The substantial growth of Korea`s economy has rendered her core technologies and industrial information into a very important role in achieving national competitiveness. This study aims at extracting how to strengthen the industrial technology protection capabilities for the Korean small and medium enterprises doing business abroad. Considering the fact that it is not long since the Republic of Korea has paid a keen attention to the industrial technology protection issue, it can be said that it has achieved considerable extent of protection system in a relatively short time. The Korean small & medium enterprises, however, differing from big enterprises are located in the weakest point. They tend to lag behind in protecting technology because of lacking management skill in that field and relevant knowledges of the provinces such as Busan. In the case of Korea with a dim recognition that the industrial technology should be firmly protected, an intelligence agency such as the Police Department, Public Prosecutors` Office and National Intelligence Service(NIS) have been and will be expected to be playing a pivotal role until the commercial sectors take on the mission by vitalizing the protection activities. Thus this study focused relationship with a police roles because small & medium enterprise beat the industrial crime single-handed. Korean small & medium enterprise have been faced with a variety of problems and countermeasures in protecting technology as follows. First the manuals for technology protection designed for each respective industry. Second they should also introduce synthetic and autonomous management system and effective technology protection system. Third Korean government and an intelligence agency should willingly assume the leadership in establishing reliable management system. Forth an expansion of exclusive police investigation office about industrial technology must be enforced. Fifth police have to closely analyze investigations and to inflict severe punishment through adopting strategic approaches. In spite of that, those works should be done in a sequential manner, taking into account of urgency and priority based upon cost-benefit analysis.
