19대 국회에 들어서 문화복지 정책에 근거한 문화(관련)법의 제개정이 발의되고 있다. 「문화예술진흥법」, 「문화산업진흥 기본법」, 「지방문화원진흥법」, 「영화 및 비디오물의 진흥에 관한 법률」, 「콘텐츠산업 진흥법」, 「예술인 복지법」, 「게임산업진흥에 관한 법률」 등의 개정안이 발의되고 있다. 또한 개인과 기업의 문화예술 지원을 활성화시키기 위한 「문화예술후원 활성화에 관한 법률안」, 대중문화 종사자의 권익 보호를 위한 「대중문화예술산업 발전 지원에 관한 법률안」, 지역 문화예술인의 법적 지원 근거 마련을 위한 「지역문화진흥법안」, 국제문화교류의 체계화와 진흥을 위한 「국제문화교류 진흥에 관한 법률안」, ‘아리랑’ 같은 무형문화재 보호를 위한 「무형문화유산 보존 및 진흥에 관한 법률안」, 유네스코의 2001년 ‘세계 문화다양성 선언’의 구체적 실행방안인 ‘문화다양성의 보호와 증진에 관한 법률안」, 국민의 여가활동 증진을 위한 「국민여가활성화기본법안」, 체육인들의 생활안정과 복지증진을 도모하고자 하는 「체육인 복지법안」, 부산의 영상문화산업 발전에 관한 「아시아영상중심도시 조성에 관한 특별법안」, 노인복지 차원에서 어르신들의 문화예술활동 증진에 관한 「어르신 여가활동 진흥법안」, 국민의 문화적 권리와 국가의 책무를 명시하는 「문화기본법안」이 제정안으로 발의된 상황이다. 이 글에서는 기본권으로서의 문화권 강화, 공급자의 창작활동 지원, 수요자의 문화 향유권 확대의 관점에서 문화복지에 접근하고자 했다. 전제가 되는 문화복지의 개념은 현행 문화법제의 규정과 유네스코의 국제 문화 협약, 대한민국 헌법 등에서 도출할 수 있다. 이를 위해 문화법제의 현황을 살펴보았고, 문화복지의 관점에서 19대 국회 제개정안의 주요 내용을 분석하였다. 이에 대한 방향을 제시하면, 먼저, 문화복지에 관한 명확한 정의가 반영되어야 한다. 추상적이거나 모호한 정의가 아닌 실제적인 규정이 요구된다. 둘째로, 기본권으로서의 문화권, 공급자의 창작활동 지원, 수요자의 문화 향유권 확대라는 문화복지의 기본 방향이 문화법제 체제에 반영되어야 한다. 마지막으로, 「문화기본법」 제정을 새롭게 추진하는 것이 문화복지의 이념과 목적에 부합하는지에 관한 논의가 요구된다. 새 법의 제정을 과도하게 모색하기보다는 현행 문화법제 간의 상충되는 규정들을 재정립하고 보완하는 개정이 반드시 선행되어야 할 것이다.

Enactment and amendment to the cultural legislation are being made ??in this initiative at 19th National Assembly. This acts are based on the policy of cultural welfare. There are amendments to Culture and Arts Promotion Act, Cultural Industry Promotion Basic Act, Promotion Act of Regional Council, Act on Promotion of Film and Video, Contents Industry Promotion Act, "Artists Welfare Act, and Game Industry Promotion Act. In addition, enactments such as Act on Cultural Arts Sponsorship Activation, Support Act on Popular Culture and Art Industry Development, Local Culture Promotion Act, Act on Promotion of International Cultural Exchange, Act on Preservation and Promotion of Intangible Cultural Heritage, Act on Protection and Promotion of Cultural Diversity, National Leisure Activation Basic Act, Athlete Welfare Act, Special Act on Establishment of the Asian Film Center City and Promotion Act On Seniors Leisure Activities have been proposed. In this article, I would like to suggest ways to improve amendments to these cultural legislation. First, a clear definition of cultural welfare should be reflected. Second, the basic directions of cultural welfare should be reflected in the legal system. Finally, philosophy and purpose of the cultural welfare in newly enacted Cultural Basic Act should be discussed.
