정보기술과 인터넷의 발전으로 등장한 디지털환경은 저작권법분야에 있어서도 많은 변화를 초래하고 있다. 즉, 인쇄매체의 역사와 함께 발전되어 온 종전의 저작권법체계를 디지털 매체에 적합한 시스템으로 변화 시켜 나가도록 요구하고 있다. 디지털시대 저작권법분야의 중심적인 논의는 디지털기술의 적용으로 발생되는 각종 디지털 저작권의 침해와 정보이용에 관한 규율 체계를 어떻게 정립할 것인가의 문제로서, 저작권법 이념의 디지털환경에의 구현, 즉 디지털 저작권자와 디지털정보 이용자간의 합리적인 권리조정과 균형정립에 관한 것이라고 할 수 있다. 이와 관련하여 최근까지도 계속하여 논의되고 있는 것 중의 하나가 디지털저작권관리(Digital Right Management, 이하 “DRM”이라 한다)에 관한 것으로서, 디지털 저작물의 불법침해와 무단이용을 방지하기 위한 기술적·관리적 조치인 DRM은 저작권자의 권리를 보호하는 데는 적절하지만, 정보이용자의 공정한 이용권을 확보하는 데에는 일정한 장애로 작용한다고 하는 것이다. 나아가 DRM은 디지털 저작물의 원활한 이용 측면에서도 그 효용성에 의문을 제기하고 있다. 즉, 디지털 저작물 보호를 위한 DRM으로 인하여 다양한 디지털 디바이스의 이용이 원활하지 못하므로 관련 사업자들이 함께 협력하여 이를 개선할 필요가 있다는 것이다. 이 논문은 이와 같은 배경에서 디지털 저작권 보호를 위한 DRM과 관련하여 최근까지 논의되고 있는 내용을 바탕으로 하여 저작권법 및 기타 관계 법률상의 이용자 보호의 측면에서 DRM 체계의 문제점을 검토하고 그 합리적인 개선방안을 모색해보고자 하였다. 특히 DRM과 공정이용의 관계를 중심으로 분석하고자 하였다. 이를 위해 DRM의 일반적 의미와 내용을 개관하고, DRM 체계가 디지털 저작물의 공정이용 또는 원활한 정보이용에 어떠한 영향을 미치고 있는지를 분석한 다음, DRM 시스템이 공정이용과 조화를 이룰 수 있는 구체적인 방안에 대하여 검토하였다.
The digital environment caused by the development of information technology and internet brought out many changes in the field of copyright law. The main issues in digital ages are how we can regulate the problems on both the prevention of copyright infringement and the fair use of digital works. In this regard, the one of them is Digital Right Management(DRM) system. DRM is the total system about technological protection measure and right management information for preventing the copyright infringement and illegal use of digital works. DRM is a very important measure for protecting the copyright of digital contents and materials, but it can be also an obstacle in fair using the digital works by ordinary user. Therefore, the necessity of reasonable improvement on DRM operating system in copyright law was being raised. This paper aims to research for the improvement methods of DRM system based on former discussion about the problems brought by DRM system. For this purpose, the general meaning and content of DRM was reviewed, and the impact of DRM were analyzed that how the DRM system bring out to the fair use of digital works, and lastly the concrete and reasonable harmonizing methods both DRM system and fair use were studied.
