엔터테인먼트산업 중 주요 분야인 음악산업이 대형화되고 국제화를 거치면서 국내외에서 급속도로 성장해 나가고 있지만, 동시에 관련 당사자 사이의 분쟁 역시 빈번하게 발생하고 있다. 새로운 음악산업이 생겨나고 변화함에 따라 이를 전달하는 매체나 기기 역시 새롭게 등장하고 이에 발맞춰 가수를 비롯한 음악실연자들에게도 새로운 권리가 인정되어야 할 필요가 있기 때문에, 음악 콘텐츠를 제작하고 이를 유통하는 과정에서 관련 당사자 사이의 권리와 의무의 범위를 조화롭게 이뤄나가는 것이 무엇보다 중요하다. 이러한 점에서 음악산업의 직접적인 당사자라 할 수 있는 가수와 실연자들이 자신의 노력만큼 정당한 권리를 보호받지 못하고 있다는 것은 문제이다. 노래연습장과 관련한 사업으로는 크게 노래반주기 제작업과 노래연습장 운영업으로 구분할 수 있다. 노래연습장 반주기를 제작함에 있어서는 음원의 작사가나 작곡가에게 저작권료에 상당하는 보상이 이뤄지는 반면, 가수의 경우에는 노래연습장의 노래 반주기에서 비록 자신의 목소리가 나오는 것은 아니지만 노래연습 장업에서 차지하고 있는 비중과 역할이 적지 않음에도 불구하고 그에 따른 적절한 보상체계가 이루어지고 있지 못하다. 노래방책자에 곡명과 함께 표기된 가수의 성명이 단순히 어느 가수의 노래인지를 선택하기 위한 색인 기능만을 제공하기 보다는, 오히려 성명을 이용한 경제적 이익의 창출에 활용되는 만큼 그에 대한 적절한 보호 필요성이 인정될 수 있다. 또한 노래연습장 반주기에서 등장하는 뮤직비디오나 방송영상 등도 해당 가수의 동의 없이 사용되거나 곡이나 가수와 전혀 무관하게 사용됨에 따라 초상권 침해의 여지가 크다고 볼 수 있다. 가수의 초상과 성명은 가수의 몫이 되고 그 고유의 재산권에 해당하는 만큼, 이를 사용함에 있어서는 권리자에게 적절한 보상이 이루어질 수 있는 체계가 확립되어야 할 것이다.

Music is established by songwriter, singer, conductors, etc. The Problem is that the legitimate rights of singer and music performers, who is direct parties in the music industry, are not being protected. In order to select the song, singer`s name which is marked in the book play an important role. Singer also has the right to use the name. Name right and right of portraits of singer are his property rights and should be protected. When name and portraits of singer used for commercial purposes, his agreement is required. And appropriate compensation should be paid.
